Staunton, October 18 -- Like many dictatorships, the Russian government of Vladimir Putin likes to use “legal” means to oppress its population, because that sleight of hand gives the patina of legality to what it is doing, thus confusing both its own people and even more those abroad who might otherwise condemn it.
But three current cases of Moscow’s misuse of law in this regard are so glaring that it would seem that all people of good will would be able to see that what the Kremlin is doing has little to do with a “law-based state” and everything to do with protecting the power and privileges of the Kremlin.
The first is the most horrific. Lawyers for Nadezha Savchenko, the Ukrainian flier who has been confined in Moscow’s notorious Serbsky Institute, is now being subjected to sleep deprivation measures, something that may not rise to the level of the punitive use of psychiatry but which recalls that practice of late Soviet times (rufabula.com/news/2014/10/17/savchenko).
Russian officials have insisted that they are only acting according to Russian law, but if that is true, then Russian law has been bent to the point that it is in violation not only of the Russian Constitution but of international human rights accords to which Moscow is a signatory and the violation of which by others Russian diplomats routinely complain.
The second “law-like” but ultimately illegitimate case involves charges of fraud brought against Lyudmila Bogatenkova, the head of the Committee of Soldiers Mothers in two districts of Stavropol Kray. The 73-year-old is now being held incommunicado until Monday when her lawyer is supposed to be allowed to see her (kasparov.ru/material.php?id=54420D5351A5C).
Her colleagues in the human rights community say that Bogatenkova’s detention is a reprisal by the Russian authorities for her work in exposing inhumane treatment of soldiers in the Russian military and the losses Russian forces have suffered since their intervention in Ukraine earlier this year.
And the third such case involves Yevgeny Vitishko, the environmental activist who is serving a three-year sentence for exposing ecological disasters and official malfeasance during the run up to the Sochi Olympiad. Not only does he remain behind bars, but the authorities have punished him and threatened to punish him further for speaking out to the media about the violation of prisoners’ rights (sobkorr.ru/news/5440D38ABC30D.html).
Vitishko’s case has attracted international attention, but it is hardly unique: Russian authorities have been arresting other members of his Ecological Watch on the North Caucasus and they have used “law-like” means to declare numerous environmental protection groups “foreign agents.” Indeed, so far, one in four of the organizations so labeled and thus threatened with closure are ecology-related (profile.ru/society/item/87382-ekolog-znachit-vrag).

Just as it seemed the Roman Catholic Church might ease its stance on homosexuality, bishops from around the world removed language doing just that from a new Vatican document. The final version of the document was issued Saturday at the close of a two-week assembly, or synod, of 200 Catholic bishops. An initial version released earlier in the week had spoken of "accepting" gays' sexual orientation and acknowledging that same-sex couples can provide "precious support" to each other. It said gay people have "gifts and qualities" that can benefit the Church. Conservatives criticized the draft, calling for major revisions, in a sign of division with progressive members of the Church. In a blow to Pope Francis, the homosexuality paragraph did not even make it into the final document, failing to reach the two-thirds majority needed to pass. The bishops also failed to approve paragraphs on allowing divorced and remarried Catholics to receive communion. Some information for this report comes from AP, AFP and Reuters.

Staunton, October 19 – Refugees from Ukraine apparently will not have to study non-Russian languages as required by the legislation of the non-Russian republics but instead will be exposed to more intensive Russian language instruction, yet another way in which Moscow is undermining the status of non-Russian tongues.
Because of the sensitivity of language issues in many republics, the authorities are not advertising this plan. In fact, officials in Cheboksary, the capital of Chuvashia, confirmed it only after an anonymous visitor posed the question on that city’s website (irekle.org/news/i1955.htmlcitinggov.cap.ru/Questions.aspx?gov_id=81#QuestionId55786).
City officials said that the 199 school-age refugees from Ukraine would not be required to take courses in Chuvash and be tested as to their proficiency in that language. Instead, “great attention will be devoted to additional training in Russian,” given that the knowledge of Russian among these children “leaves much to be desired.”
As Irekle.org notes, Chuvash activists have been pushing for more Chuvash instruction while officials have been taking a variety of steps to reduce the amount of instruction and the use of the national language there, including taking down signs in Chuvash before Vladimir Putin’s visit and proposing to replace classroom instruction in Chuvash with distance learning.
More than a million Chuvash say they speak that Turkic language, but international organizations have identified it as a language at risk because of the expansion of Russian language use there and because it is not mutually intelligible with other Turkic languages and thus Chuvash cannot save their language by getting training in other Turkic republics.

Staunton, October 19 – Russia’s 25-year-long era of freedom, which began in 1989 with the Congress of Peoples Deputies, has come to an end and the prospects for the future are extremely bleak, according to Academician Yury Pivovarov. If Russians do not transform themselves, their country risks becoming part of the third world.
In an interview in “Russkaya planeta” today, Pivovarov, the head of the Moscow Institute of Scholarly Information on the Social Sciences of the Russian Academy of Sciences, talks about his new book, “The Russian Present and the Soviet Past,” which is in the form of a diary he kept from 2008 to 2014 (rusplt.ru/policy/epoha-svobodyi-v-rossii-zakonchilas-13690.html).
The academician notes that as Nabokov put it, “Russia has two histories, the history of the secret police and the history of secret freedom.” Unfortunately, he says, at present, the former “has become stronger than the latter,” not so much in the form of Vladimir Putin and his Chekist allies but in “the unfree and authoritarian tendencies” of Russian society inherited from the past.
The events of this year, Pivovarov says, show just how few of the members of Russian elites have escaped from this inheritance. “This is the madness from Crimea to ‘Novorossiya,’” a term he puts in quotes “because I do not know what this is. We have entered on a very dangerous path.”
The scholar says that for him, “events in Ukraine are not only events there,” given that his wife is Ukrainian and his son is thus half Ukrainian. “In this conflict, we are talking above all about Russia. Lenin once wrote that we will convert an imperialist war into a civil war. And he was able to do this at least in Russia.”
“Putin, whether he wants it or not,” is at risk of doing the same at least to some degree. The Russian president has destroyed at least for a time “the perfectly normal opposition of the authorities and the opposition” by engaging in what can only be described as an “’imperialist’” war in Ukraine.
The Moscow media’s focus on Ukraine to the exclusion of all Russia’s internal problems, poverty, income differentiation, and social tensions of various kinds is extremely dangerous, and in many ways it recalls the Soviet past when the Soviet media talked about the persecution of blacks in the United States but ignored what was wrong in the USSR.
Pivovarov says that he decided to shift from his scholarly pursuits to write a book of this kind because “Putin himself has put a period in my ‘novel,’ because an era has ended” and it is necessary to find a way to declare “’the Fatherland is in danger!’”
The INION scholar, who long specialized on the late imperial period, praises Nicholas II in his new book for the relatively peaceful development of Russia and the last tsar’s willingness to compromise on many issues including on a constitution after the first Russian revolution, a willingness that he expresses regret Putin does not share.
“If Putin had reacted to the Bolotnoye demonstrations by seeking to meet the opposition part way, everything for us would be better. If he were to look at the history of Russian power, he would see that it has been successfully only when it has minimized its own possibilities and delegated them to society.” But that has not happened.
If Russia is to move forward, Pivovarov says, “we must cease to be Soviet people and overcome the Soviet in us.” The Soviet man was and is “cut off from world culture and from its religious component. He may go to church, but he is not influenced by this culture, for him it is not a source of good and morality.”
Stalininism, Leninism, Bolshevism and Communism represent “a rejection of the Christian understanding of the personality, a rejection of the idea of original sin which is in each man and therefore each must begin with himself” in order to cope and improve the situation.
“But Stalinism says that it is the class enemy, the masons, NATO, the United States, and the Banderites who are guilty. Anyone you like except for [Russians themselves].” As things stand now, changing that is going to be very, very difficult. Solzhenitsyn said it might take 200 years, the INION director says.
At the same time, he says that he is not without hope. Yes, 84 percent of the population support Putin, but there is the other “16 percent who do not want live according to these arrangements and in a new isolation. They form civil society, but alas they do in large measure continue to remain soviet as well.” As a result, they are part of what they are also fighting.
“The Soviet man,” Pivovarov says, “is someone for whom self-organization is completely alien. Given an order, he can achieve heroic deeds, but he cannot organize himself.” Many forms of self-organization were destroyed by the Soviet system, a few have been restored, but this is “not sufficient.”
And he concludes: “Today, Russian people are more ready to be organized for evil than for good.” That is disturbing because “either Russia will find in itself the strength to transform itself and become European, democratic, law-based, Christian and patriotic, or it will decline and become a third world country.”
