Obama and Saudi King Sidestep Dispute Over Iran Nuclear Deal

WASHINGTON — President Obama and King Salman of Saudi Arabia met at the White House on Friday in hopes of moving past their differences four months after the king refused the president’s invitation to visit amid concerns over American negotiations with Iran.
During brief public remarks at the beginning of their meetings, neither of the leaders directly addressed the disagreement that has driven a wedge between their countries, namely the deal to lift sanctions against Iran in exchange for limits on its nuclear program. Instead, they stressed a long history of cooperation and friendship between the United States and Saudi Arabia.
“We’ll discuss the importance of effectively implementing the deal to ensure that Iran does not have a nuclear weapon while counteracting its destabilizing activities in the region,” Mr. Obama told reporters in his only reference to the Iran agreement. King Salman made no mention of Iran at all in his response.
Saudi leaders have grudgingly come to accept the Iran agreement despite deep reservations about its effectiveness, a recognition on their part that they cannot stop the deal from going forward. While Congress may vote to reject the agreement, Mr. Obama has corralled enough Democratic votes to sustain a veto of a Republican resolution of disapproval.
A short overview of important highlights from the Iran nuclear deal.
The king’s decision to come to Washington was a signal that the Saudis are now focused on making the best of the situation. The Pentagon is finalizing a $1 billion arms agreement with Saudi Arabia that will provide weapons for its war effort against the Islamic State and Yemen, part of an Obama administration strategy of tamping down opposition by Persian Gulf states to the Iran deal through increased security cooperation.
Saudi Arabia had stiffed Mr. Obama when he first tried that approach in the spring with a summit meeting at Camp David of the leaders of six gulf states. The White House initially announced that King Salman would attend, only to be caught off guard when Saudi officials said that he would instead send two top princes to represent him. At the time, some administration officials denied that it was a snub, suggesting that the trip might be too arduous for the 79-year-old monarch.
King Salman seemed unrestrained by physical limits four months later, however, as he and Mr. Obama resolved to move ahead on a variety of issues, including counterterrorism, business and energy.
“Once again, Mr. President, I’m happy to come to a friendly country to meet a friend, and we want to work together for world peace,” the king said in the Oval Office. “Our region must achieve stability, which is essential for the prosperity of its people and in our country thank God we are prosperous, but we want prosperity for the entire region. And we are willing to cooperate with you in order to achieve that.”
During their public remarks, Mr. Obama touched only briefly on the other difficult issues confronting the two, including the war in Yemen, where American officials have expressed concern that Saudi military actions have caused civilian casualties, and in Syria, where the two sides cooperate against the Islamic State but have deep disagreements about how to handle the broader civil war...

Feds Spend $236,517 for Cellphone Game to Teach 11-Year-Old Kenyans How to Use Condoms

The National Institutes of Health (NIH) is spending over $200,000 to create a mobile game that will teach young teens in Kenya to use condoms.
The game also seeks to “educate very young adolescents” about HIV and “harmful gender norms.”
“The overall goal of the proposed project is to contribute to reductions in HIV incidence among youth in sub- Saharan Africa,” according to the NIH grant. “The objective of our proposed study is to advance that goal by developing, building and pilot-testing an interactive electronic game for preadolescents that will be informed by socio-behavioral and pedagogical theories, evidence-based practice, and unique formative research on youth sexual culture in sub- Saharan Africa.”
The primary goal of the project is to “design and develop a mobile phone game for young Kenyans ages 11-14 focused on increasing age at sexual debut and condom use at first sex.”
The game will be tested on 60 young teens in western Kenya to see whether they are willing to play the game and to evaluate how much they like it.
Researchers believe the game could reduce unintended pregnancy, “challenge harmful gender norms and HIV stigma, and foster dialogue with parents and guardians.”
The study has cost taxpayers $236,517 so far.

There’s Still Room for Mischief After Iran Deal Vote

It became clear this week that opponents of the Iran nuclear agreement willnot have the votes in Congress necessary to retract the President’s sanctions waiver authority by means of H.J. Res. 64, a resolution of disapproval. The President needed at least 34 “no” votes in the Senate in order to sustain his promised veto. With the addition of three more senatorswho announced Thursday that they will support the deal, the President may even reach 41 no votes, which would be the number required to successfully filibuster the measure designed to block the deal. If that happens, there is a chance the Senate Majority Leader wouldn’t even bring it to the floor, although there are significant political benefits to forcing the vote. More importantly, a filibuster would spare the President from having to use the veto.
Over the coming weeks we will move from the congressional acquiescence phase to the implementation phase. We now know that Congress will not formally prohibit the Iran deal. However, the deal will likely move forward under the weight of votes recording opposition from a majority of Senators and Representatives, which is not optimal as a matter of public diplomacy and resolve.
Now that the fate of the resolution of disapproval has become clear, some opponents of the Iran deal have started to float trial balloons about how to undermine the deal rather than defeat it outright. During the remainder Obama administration, most of those balloons will pop on the horns of the President’s veto power. However, there are some opportunities for opponents’ influence and mischief during the implementation phase.
A couple of ideas suggest that Congress do something short of categorical disapproval. For example, Orde Kittrie argues that Congress should pass language in the resolution of disapproval that would “specify what changes would be needed to meet congressional requirement.” He cites a long history of congressional rejections and conditions related to treaties and international agreements. He notes that “[o]ur negotiating partners should not be surprised if Congress takes the less drastic step of returning it to the President for renegotiation.” Express conditions from Congress could have the effect of making Congress appear more constructive than obstructionist. But that legislation would still have to overcome the President’s veto. Therefore, the persuasive value of this approach on the Senate membership vis-à-vis a veto-proof majority — and not its persuasiveness to domestic and international audiences — would be the only salient political effect.
Sen. Bob Menendez (D-NJ), who opposes the deal, suggested that Congress disapprove it but authorize the Joint Plan of Action, which would release $700 million per month while Iran negotiates in good faith. This, too, would be a modest signal of good faith on Congress’s part but it would again require a veto-proof majority due to President Obama’s opposition.
In a different approach, Sen. James Inhofe (R-Okla.) and Oklahoma’s Republican Attorney General Scott Pruitt argue that the states should sanction Iran notwithstanding the terms of the Iran deal. They cite provisions of the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 (CISADA) that authorize states “to divest the assets of the State or local government from, or prohibit investment of the assets of the State or local government in, any person that the State or local government determines … engages in investment activities in Iran.” CISADA Section 202(f) expressly disclaims federal preemption in order to avoid issues presented in Crosby v. National Foreign Trade Council and American Insurance Association v. Garamendi.
The Iran deal does nothing to withdraw state divestment authority. Secretary of State John Kerryconfirmed in congressional testimony that the Iran deal, as an executive agreement, leaves that authority undisturbed. However, pursuant to the Iran deal, the administration agreed to “actively encourage” states to drop their sanction on Iran. Secretary Kerry stated that “if Iran is fully compliant with the agreement … we will take steps to urge [the states] not to interfere” by continuing sanctions.
The state authority provision is consistent with cooperative federalism of an aggressive and comprehensive Iran sanctions regime. However, now that the Executive seeks to ease sanctions on Iran pursuant to the deal, Inhofe and Pruitt seek to invoke the state authority in a spirit of uncooperative federalism. While the scope of state authority is limited to public monies, aggressive state sanctions identifying individuals and corporations as Iran business partners would frustrate Executive policy to a degree.
Areas in which Congress certainly has a continued role, and therefore leverage, are appropriations and oversight. Last month, Sen. Lindsey Graham (R-SC) threatened to withhold US funding for the International Atomic Energy Agency (IAEA) unless Congress is allowed to review the agreements between the IAEA and Iran designed to implement inspections and enforcement of Iran’s obligations under the deal. The United States provides around $88 million to the IAEA annually, which is approximately a quarter of its yearly budget. Given Graham’s role as chair of the relevant Senate appropriations subcommittee, it is not an idle threat. (A side note: I am working on a law review article that explores congressional oversight interests as applied to international organizations and foreign sovereigns that receive US funds.)
The Executive has periodic reporting requirements that will serve as oversight forcing functions. Sharon Squassoni and Chris Coughlin suggest that Congress establish a task force for Iran Deal Compliance or that the Senate reconstitute the Arms Control Observer Group as platforms for coordinated and sustained oversight of compliance with the nuclear agreement. Congressional leadership would have to weigh the policy coordination and public message value of a unified oversight platform against the likely resistance by committee chairs with existing oversight jurisdiction. In any scenario, a Congress that is inhospitable to the Administration’s Iran policy will continue to control appropriations and conduct oversight.
Three major events next year could also have a major effect on the implementation phase: (1) US congressional elections, (2) the US presidential election, and (3) the sunset of the Iran Sanctions Act. Congress could either remain opposed by a simple majority, increase opposition to veto override levels, or become supportive of the Iran agreement. The new President could change Iran policy, as several Republican candidates have promised to do.
Further, the sunset provision will force congressional action on our complicated Iran sanctions regime that will play into the election outcome dynamics. At present, Menendez and Sen. Mark Kirk (R-Ill.) have introduced legislation that would extend the Iran Sanctions Act by 10 years. Sen. Bob Corker (R-Tenn.) has promised to pass that legislation out of the Senate Foreign Relations Committee after the vote on the disapproval resolution. However, a successful extension will require normal bicameral passage and presentment. Therefore, legislation hostile to Executive policy would have to survive a veto, and negotiations will be conducted in a veto’s shadow.

The horrors of the first world war were clear enough to everyone who fought in it, as Wilfred Owen did: “If in some smothering dreams, you too could pace / Behind the wagon that we flung him in, / And watch the white eyes writhing in his face, / His hanging face, like a devil’s sick of sin / If you could hear, at every jolt, the blood / Come gargling from the froth-corrupted lungs”.
But for those who watched from the comfort of the home front, it was still easy to believe the old lies. It took 10 years or more from the end of the fighting for Owen to be widely read, and for the great novels and prose memoirs to appear which peopled the trenches with individual soldiers whose deaths made a terrible and compelling sense so that a whole generation saw through the uplifting official generalities to the grotesque and particular horrors of reality. Something like that has happened now, very much more quickly, with the death of Aylan KurdiOne photograph has turned something we all knew was happening, but somewhere little-known and far away, into a wrenching tragedy that demands immediate action.

What the Image of Aylan Kurdi Says About the Power of Photography

The heartbreaking photograph of a dead 3-year-old boy, whose body washed up in Turkey on Sept. 2, has already had an impact on policy, with the U.K. agreeing on Friday to take thousands more refugees. The image itself also marks important new ground, photography experts tell TIME.
Aylan Kurdi and his 5-year-old brother, Galip drowned after their overloaded boat capsized off of the coast of Turkey. Aylan’s body was discovered on one of Turkey’s beaches in the Bodrum Peninsula. Images of the ghastly find, photographed by Nilufer Demir from Turkey’s Dogan News Agency, were shared on social media and on the front pages of newspapers around the world, particularly in the U.K. and in Europe. As they spread, and as individuals and organizations faced the decision of whether and how to publish them, those pictures have ignited a new kind of conversation about the crisis.
“The reason we’re talking about this photograph is not because it’s been taken or not because it’s been circulated, but it’s because it’s been published by mainstream media,” says Hugh Pinney, vice president at Getty Images, a distributor of news images. “And the reason we’re talking about it after it’s been published is because it breaks a social taboo that has been in place in the press for decades: a picture of a dead child is one of the golden rules of what you never published.”
The last time a photograph of a dead child was widely published was in July of 2014 when New YorkTimes photographer Tyler Hicks captured the mangled bodies of four Palestinian youths killed in an Israeli airstrike on a beach in Gaza. What is unique about this case, however, is that many news outlets’ decisions to publish the images followed a public outcry on social media. “We got to this point because individuals have had the balls to publish the pictures themselves on social media,” says Pinney. “I think that gave the mainstream media the courage and the conviction to publish this picture.”
In some ways, the power of the picture can be explained by its minimalism. “It’s a simple photograph that deals with an essential truth,” says Dimitri Beck, the editor of the photojournalism magazinePolka in France. “It’s not a sophisticated image, even in its framing, but the message is clear and direct: a kid has died and he’s being picked up like a washed-up piece of wood on the beach. There’s nothing more violent.”
Peter Bouckaert, Human Rights Watch’s emergencies director, was one of the first to draw attention to the photograph on Twitter and Facebook. “It’s, sadly, a very well-composed image showing a little toddler that we can all identify with, with his little sneakers and shorts on,” he tells TIME. “I think for a lot of the public, their first reaction is: ‘This could have been my child.’”
Bouckaert argues that the child’s ethnicity played a role in the image’s impact. “This is a child that looks a lot like an European child,” he says. “The week before, dozens of African kids washed up on the beaches of Libya and were photographed and it didn’t have the same impact. There is some ethnocentrism [in the] reaction to this image, certainly.”
The photograph appeared on the cover of The Independent in the U.K., among other titles, and in Le Monde, the only French newspaper to publish the photograph on Thursday. “I’m convinced that until you’ve shown this photograph, you haven’t shown the reality of this crisis,” says Nicolas Jimenez, director of photography at Le Monde. “We’d written about it in the past, but we hadn’t shown it in such a hard way. I feel that to show like this is an important step.”
Of course, Jimenez adds, the decision to publish such a graphic image on the newspaper’s front page was a hard one to make.
“I don’t think I ever got so many calls from newspapers editors and photo editors than I did on that day,” confirms Bouckaert, who works closely with media organizations in their coverage of humanitarian crises. “They all really grappled with the decision of whether or not to use this image. At the end of the day almost all of them did. I think that when we have this discussion time and time again, it always comes down to: ‘This is an image people have to see. This is an image that can galvanize attention around a crisis that has been ignored for too long.’”
For Getty’s Pinney, the image gave photo editors a way to humanize a crisis that had, so far, been illustrated by crowded boats and border points. “I think it’s very brave, particularly on this story, because it’s very easy to forget that this story is rooted in conflict,” he says. “It’s just seen as a journey, as a migration of people from point A to point B. This picture marks a watershed in this story, when finally people are starting to realize that this is about real people and about the fact that people will risk everything — the lives of their children — to cross open waters.”
David Levi Strauss, the cultural critic and poet, believes the image will live on in history. “It is one of those images that seems to arise from out of the collective unconscious,” he tells TIME. “Comparisons have already been made to Nick Ut’s image of a young Vietnamese girl running naked from a napalm attack, which is credited with helping to shift world public opinion against the war in Vietnam. One also cannot help but compare it to the image of Michael Brown’s body, lying face down in the street for hours, which fueled uprisings against police violence in Ferguson, Missouri, last year and ignited the Black Lives Matter movement. The image of the death of Aylan Kurdi is a simple image, really, but it will not go away for a very long time.”
Bouckaert hopes Levi Strauss is right. “My hope is that this image will not just shock us but it will push us to take a personal commitment to try to stop these senseless deaths in the Mediterranean. If it accomplishes that, it will be an image that has contributed a lot to the world.”
Pierre Terdjman, a French photojournalist and the father of a 2-year-old boy, agrees. “This photograph is not more important than the hundreds of other documents that photographers have made about these refugees and these victims, and it’s sad to see that it had to be shared around Twitter by thousands of people for it to attract this kind of attention.”

Dem Sen. Cardin Opposes Iran Deal that Would Endorse ‘Industrial-Scale Nuclear Program’

Sen. Ben Cardin (D., Md.), the ranking member of the Senate Foreign Relations Committee, announced his opposition to the Iran nuclear deal Friday.
Cardin penned an op-ed for the Washington Post during which he accused the Joint Comprehensive Plan of Action (JCPOA) of “legitimiz[ing]” Tehran’s nuclear program while leaving the door open for the country to quickly generate a nuclear weapon after 10 to 15 years of implementation.
“The JCPOA would provide this legal path to a country that remains a rogue state and has violated its international nonproliferation obligations for years,” Cardin explained. “It would provide Iran with international endorsement of an industrial-scale nuclear program.”
“Worse,” the Democratic senator continued, “Iran would be economically strengthened by frighteningly quick relief from sanctions and international economic engagement. If Iran violates the agreement, building international support for new sanctions would take too long to be effective. A military response in this scenario would be more likely, although disastrous.”
Cardin criticized the language of the agreement for describing its implementation as “based on mutual respect” between Iran and world powers.
“There cannot be respect for a country that actively foments regional instability, advocates for Israel’s destruction, kills the innocent and shouts ‘Death to America,’” Cardin wrote.
He stressed that each lawmaker’s decision regarding the agreement should be a “vote of conscience” rather than a “litmus test of party loyalty or political acumen.”
“Discomfort with aspects of the agreement remains across the ideological spectrum,” Cardin said.
The Maryland Democrat’s announcement of disapproval comes just days after his colleague Sen. Barbara Mikulski (D., Md.) cast the crucial 34th vote in favor of the deal. As a result, supporters of the agreement will be able to uphold a promised veto from President Obama of a congressional resolution to reject the deal that Republicans are aiming to pass later this month.
Cardin joins other prominent Senate Democrats in ultimately rejecting the deal. Both Sens. Chuck Schumer (D., N.Y.) and Bob Menendez (D., N.J.) have come out against the nuclear deal brokered in July, provoking frowns from the Obama administration.
While the president has held onto enough support in the Senate to force the success of the nuclear agreement, it remains unpopular among the American public. An increasing majority of Americans want Congress to reject the deal, according to recent polling.
