A Texas legal panel voted on Monday to disbar a former prosecutor for sending an innocent man to death row by presenting tainted testimony and making false statements that undermined the defendant's alibi.

The Board of Disciplinary Appeals appointed by the Texas Supreme Court upheld a state licensing board's decision to disbar Charles Sebesta for his conduct in convicting Anthony Graves, who spent 18 years in prison on charges of setting a fire that killed six people before being freed. 


Sebesta had convicted Robert Carter for the murders and tried to get Carter to say Graves was an accomplice. But the day before he was to testify, Carter told Sebesta he acted alone and Graves was not involved, the board said.

"Sebesta never disclosed this information to the defense," the board said.

Sebesta then presented false testimony implicating Graves, crucial in a conviction since there was no physical evidence linking him to the crime, it said.

Before Graves' attorney was to present the alibi witness, Sebesta falsely stated in court that the witness was a suspect in the murders and could be indicted. The witness refused to testify and left the court, it said.

Graves' conviction was reversed in 2006 and he was remanded for a new trial. In 2010, a special prosecutor found there was no credible evidence that Graves was involved in the murders and Graves was then released.

Sebesta said he was being unfairly treated and that Graves was justly convicted.

"I am concerned about the process," he said in a telephone interview, adding he was being targeted by state bar attorneys.

"My opinion is that we presented the evidence we had and felt like it was sufficient," he said of the Graves case.

One of Graves' pro bono lawyers applauded the decision.

“In rejecting Sebesta’s argument, the Board of Disciplinary Appeals found that Charles Sebesta’s misconduct was so egregious that they characterized him as having ‘unclean hands.’ That certainly is a fitting description,” said Neal Manne.

A study this month said that U.S. exonerations hit a record high in 2015 as more prosecutors have been looking at troubled cases.

The issue has gained additional attention because of the hit Netflix documentary series "Making a Murderer," which suggests authorities planted evidence against two Wisconsin men convicted of murder. The allegation has been rejected by local law enforcement.

investigators say they have collected evidence of widespread torture and execution of detainees by the regime of Bashar
Assad and several antigovernment armed groups fighting in Syria, and that these acts amount to crimes against humanity.
In a report to the U.N. Human Rights Council, published Monday, the Independent International Commission of Inquiry on the Syrian Arab Republic detailed the findings of an investigation over more than four years, which included hundreds of interviews with former detainees, family members of the deceased, and former regime functionaries.
“Massive and systematized violence — including the killing of detainees in official and makeshift detention centers — has taken place out of sight, far from the battlefield,” a summary of the report said.
“The government has committed the crimes against humanity of extermination, murder, rape or other forms of sexual violence, torture, imprisonment, enforced disappearance and other inhuman acts,” it added. “Based on the same conduct, war crimes have also been committed.”
The report said executions and mistreatment of prisoners were also common among rebel groups, naming the al-Qaeda-linked Jabhat al-Nusra and the Islamic State of Iraq and Greater Syria (ISIS) — both of which, the report said, had committed torture and summary executions of enemy combatants.
The report comes after U.N.-mediated peace talks in Geneva were suspended last week with no agreement reached on how to bring to an end the long-running conflict, which is estimated to have killed 250,000 people and sent nearly 5 million Syrians overseas. It will be discussed at a Human Rights Council session beginning Feb. 29.
“Accountability for these and other crimes must form part of any political solution,” the report states. “The situation of detainees is critical, and represents an urgent and large-scale crisis of human rights protection. Urgent steps must be taken by the Syrian Government, armed groups, external backers, and the wider international community to prevent further deaths.”

Kadyrov Tests Moscow’s Strategy in the North Caucasus

On February 2, Chechen ruler Ramzan Kadyrov convened an unusual gathering of followers of the Naqshbandi and Qadiriyya Sufi orders in Grozny. Apart from the participants from Chechnya, “thousands” of other Sufis arrived from Dagestan, Ingushetia and other republics of the North Caucasus, Kadyrov claimed via Instagram. The rally of the Sufis, which Kadyrov called a “majlis,” declared that true Muslims should fight the so-called Wahhabis (Salafists), which essentially include everyone who does not belong to the Naqshbandi and Qadiriyya Sufi orders. Kadyrov approved of the actions of the Dagestani government against the Salafists and expressed hope that “the pseudo-Salafists’ attempts to legalize themselves and sneak into various councils will receive a “proper rebuttal” in Ingushetia as well (Instagram.com/p/BBSbompiRod, February 2).
Kadyrov has been unusually active in the past several weeks. First, Chechnya’s governor attacked the Russian opposition in a way that some regarded as essentially death threats. He then turned his attention back to Chechnya’s neighborhood by rallying Sufis of the North Caucasus and presenting himself as the defender of the Sufi dominance in the region. Formally, Russian law does not permit discrimination against religions and sects, as long as they obey Russian laws and are not officially outlawed. In practice, the Russian authorities find ways to discriminate against undesirable religions and denominations. However, no political figure could dare do what Kadyrov has done—declare an official fight against what he called “pseudo-Salafists.”
Kadyrov himself tried to keep a low profile at the rally of the Naqshbandi and Qadiriyya Sufi orders, saying that he attended only as the follower (murid) of Kunta-Haji Kishiev, a Chechen sheikh who lived in the 18th–19th centuries. However, Kadyrov’s statements were quite brusque and bold, as usual: he said that he and his associates swore to fight the Wahhabis “until death” and would pursue them everywhere. “We do not care where they are—in Chechnya, in Ingushetia, in Dagestan or even in North Africa,” he said. “If the locals cannot stop them and if they do not come to their senses and repent, they will get what they are seeking. Everybody will get what he seeks.” Kadyrov then went on to describe the situation in both Dagestan and Ingushetia as precarious in this regard. Chechnya’s ruler in particular said that he was unhappy about Salafists receiving public platforms in the neighboring republics and expressed doubts that the regional authorities were capable of dealing with the problem. Kadyrov warned the Salafists to stop undermining the Sufi saints, or otherwise face repercussions (Kavkazskaya Politika, February 4).
The Sufi rally held in Grozny under Kadyrov’s auspices is significant in at least several respects. First of all, Kadyrov claims to be the defender of the Sufis, who are under increasing pressure from the Salafists. The latter have made substantial inroads into the Muslim population across North Caucasus, where Sufism has traditionally dominated. Secondly, Kadyrov is focusing particularly on neighboring Ingushetia, which is ethnically close to Chechnya and whose separate identity is therefore vulnerable to Kadyrov’s claims that the Chechens and Ingush are the same people.
Religious differences could easily spiral into violence in Ingushetia, Chechnya and Dagestan. Ingushetia’s governor, Yunus-Bek Yevkurov, hastily called on the residents of his republic to stay calm and stop attacking those who have different religious beliefs. Instead of accusing the young people of rejecting the old way of worship, Yevkurov asked the religious leaders to initiate a dialogue and resolve their differences (Facebook.com, February 4). The Ingush civil activist Magomed Mutsolgov appealed to Russian law enforcement officials, asking them to provide a “legal assessment” of Kadyrov’s statements. In Mutsolgov’s opinion, Kadyrov made incendiary comments against all the Muslim religious groups that do not belong to the Naqshbandi and Qadiriyya Sufi orders, which is a criminal offense (Kavkazsky Uzel, February 4). Ingush religious leaders also addressed the Russian authorities, asking them to stop Kadyrov’s incendiary activities (06portal.ru, February 7).
Kadyrov’s earlier attacks on the Russian opposition caused a significant uproar in Russia. The Kremlin seemed to justify his comments, while not overtly endorsing them. Now, Kadyrov seems to have identified a safer area for the expansion of his influence—the North Caucasus and Islam in the region. Moscow has supported “traditional Islam” in the North Caucasus in its attempt to hold back and eliminate the Salafist type of Islam in the region. Salafists are often equated with the insurgency; but perhaps most importantly, the Salafists are not under control of the authorities—something the Russian government does not tolerate. In fact, the very reason for the popularity of the Salafists may be that they are relatively independent of the government. Thus, Moscow should presumably support Kadyrov’s crusade against the “wrong” Islam. However, if Moscow supports Kadyrov and his crusaders, it will expand his influence, along with that of Sufism. Ironically, the North Caucasian regional governors, especially Ingushetia’s Yevkurov, find themselves in the position of endorsing the pan-Islamist teaching of Salafism rather than the local-based Sufism, because the latter is used by Kadyrov to undermine their authority. It is unclear what position Moscow will take. On the one hand, Moscow probably has no interest in seeing the expansion of Kadyrov’s influence beyond Chechnya but, at the same time, is afraid of a religious teaching it does not control. Intentionally or not, Kadyrov put Moscow in the position that its influence in the North Caucasus will be undermined whatever move it takes.

Bill Clinton Mocks Sanders’s Peace-Loving, Revolutionary Image

Bill Clinton tore into the Sanders campaign Sunday at an event in New Hampshire, mocking Sanders’s anti-establishment, pro-revolution platform.
The former president slammed the Sanders campaign as shady and untrustworthy, despite their peace-loving image and Sanders’s high authenticity numbers. Clinton said that Sanders manipulated endorsements of Hillary Clinton to his advantage and rejected critics as anti-establishment.
“Bernie took what they said good about him and put it in under all these endorsements, except they didn’t endorse,” Clinton said. “But if you pointed out, just shows you how tied you are to the establishment.”
He then mocked Bernie Sanders’s core campaign idea that America needs a political revolution.
“I mean, when you’re making a revolution, you can’t be too careful about the facts. You’re just for me or against me,” Clinton said and the crowd laughed.
He pinned the December breach of the Clinton campaign’s voter database in October on the Sanders campaign, and said that Sanders’s apology was two-faced.
“It was your campaign that made 25 separate inquiries in the mere space of 30 minutes, trying to loot information out of computers,” Clinton said. “They said, ‘we apologize for that.’ Yeah, in public they did.”
He said that while the Sanders campaign tried to blame the Democratic National Committee for the breach, they were actually guilty of stealing.
“In private they sent an email out complaining, blaming the Democratic Party for leaving the keys in the car. ‘All I did was drive it off,’” Clinton said.
Since getting in trouble for making aggressive remarks about then-opponent Barack Obama in 2008, Clinton has toned down his rhetoric when stumping for Hillary. His remarks Sunday, however, represent a marked escalation in rhetoric.

Bill Clinton: Hillary Wasn’t Responsible for Benghazi Consulate’s Security

Former president Bill Clinton suggested Sunday that his wife Hillary Clinton was not responsible for the security of the Benghazi consulate while she was secretary of state, claiming she had been absolved by a “very tough report” on the 2012 terrorist attack.
“A non-partisan, very tough report on the Benghazi incident said there were serious holes in the way we provided for security, not just for the two State Department employees who lost their lives, one of them was a very close friend of ours, but for the two CIA contractors who were there trying to provide defense,” Clinton said. “But the secretary of state was not personally responsible because no secretary of state had ever overseen the details of security operations, even Colin Powell, who was Chairman of the Joint Chiefs of Staff.”
Speaking at an event in New Hampshire, Clinton said the scrutiny Hillary faced since leaving the State Department amounted to something that “no public official in the history of the republic has ever faced.”
Republicans “went to work on her for three years,” he said, appearing to blame the fall in her popularity since she was secretary of state on partisanship.
Hillary Clinton now finds herself trailing Sen. Bernie Sanders (I., Vt.) in the New Hampshire polls with the primary a day away. Bill Clinton has sharpened his attacks on Sanders in recent days, accusing supporters of Sanders of sexism during the same appearance Sunday.
