New questions arise about House Democratic caucus’s loyalty to Obama

Cheers rang out Thursday evening when President Obama made a surprise visit to the annual congressional baseball game at National Park. Thousands of Democratic staffers began to chant: “O-ba-ma! O-ba-ma!” More unexpectedly, Republican lawmakers and staffers, who have been locked in battle with the president for more than six years, began a cheer of their own: “TPA, TPA!” they chanted, voicing approval for Obama’s trade promotion agenda.
Obama flashed the GOP side a thumbs-up.
Inside the Democratic dugout, according to several senior aides and lawmakers, the president’s usual allies were appalled by the scene: He was waving to Republicans in approval of trade legislation that most of them opposed.
A day later, the Democratic team threw the president a curveball by blocking his high-stakes bid to win fast-track authority to complete a sweeping, multinational Pacific Rim free-trade accord. For Obama, who has staked enormous personal credibility and political capital on the effort, the loss on Friday represented a major setback on a key presidential priority and renewed questions in Washington about his relationship with the House Democratic caucus.
Though the White House and GOP leaders quickly vowed to try again on trade next week, the rebuke from the president’s own party — despite a personal plea from Obama on Capitol Hill just hours before the vote — sent a clear message that their own skepticism on trade trumped their faith in Obama. The blow left his trade agenda on life support.
“Unfortunately, Democrats did not heed his message,” said Rep. Gerald E. Connolly (D-Va.), who supported the trade deal. “Trade is an existential issue for a lot of Democrats. That transcends everything, including loyalty to him. A lot of Democrats were really anguished about that very choice. They were saying, ‘I don’t want to harm him. I don’t want to damage him. But I can’t go home to my district and say that out of loyalty to him, ‘I sold you all [out].’ ”
The outcome was especially frustrating for a president who has spent four years unable to advance major initiatives — including a tax and budget “grand bargain,” stricter gun control and immigration reform — through Congress in the face of relentless Republican opposition.
After the midterm elections, Obama and his advisers gambled that with the GOP in control of both chambers for the next two years, the scrambled politics of trade would offer the president his best chance to score a legacy-building win in the final stretch of his presidency. Assuming that he could convince more than a sliver of his own party to support him.
He faced significant odds: Democrats have long been skeptical of the effects of trade, which labor unions have blamed for lost jobs and falling wages in traditional, blue-collar manufacturing sectors.
The president launched an administration-wide lobbying effort that lasted months and, by virtually all accounts, was more exhaustive and personal than any push he has made since the health care reform effort in his first year.
He phoned and met with key Democratic lawmakers, promised to campaign for them against primary challenges and invited them aboard Air Force One for a trip to a European summit. He traveled to Oregon in May to give a trade speech at Nike in the home state of Sen. Ron Wyden (D), who offered crucial support to help win passage of the fast-track legislation in the Senate.
“The president is personally engaged on this,” Sen. Ron Wyden (D-Ore.), who helped win passage for the fast-track bill in the Senate, said of Obama on Thursday. “He’s all in.”
But his surprise appearance at the congressional baseball game — the presidential motorcade departed the White House after aides had declared he was in for the night — betrayed the confident tone from administration officials on the eve of the House vote.
During his tenure, Obama has been criticized by both sides of the aisle for ignoring lawmakers, courting them only when absolutely necessary and failing to establish personal connections that could help him politically.
That the president was attending an exhibition game that was not on his public schedule showed the lengths he felt he had to go to try to salvage his trade deal.
By Friday morning, however, the vote remained in doubt — and Obama was leaving the White House on another scheduled trip, this time to Capitol Hill for an emergency meeting with the House Democratic caucus. Once there, he huddled privately with House Minority Leader Nancy Pelosi (D-Calif.) and her deputies, before addressing the entire membership.
“You could always say there coulda, shoulda been more with any president,” Connolly said, when asked if Obama’s lack of attention to lawmakers over the years harmed his chances on trade. “This president’s style is different than Bill Clinton’s. He is who he is. I don’t know if somehow it’s fundamentally flawed. It’s just different.”
Most in Congress agree on one thing: The administration, despite its blitz in recent weeks, was facing an opposition, made up of labor unions, environmentalists and progressive Democrats, that has been relentless in lobbying against trade. Led by Rep. Rosa L. DeLauro (D-Conn.), the coalition has met with individual Democrats and with small groups for more than two years to pressure them to oppose any fast-track bill.
Asked by reporters after the vote if Obama’s trade push came too late, White House press secretary Josh Earnest scoffed.
“I find it hard to believe that the president’s attendance at the 2014 congressional baseball game would have, in any way, contributed to the vote count today,” he said. “I think that the president takes much more seriously members of Congress and their concerns than some analysts do.”
But Obama appeared to be blindsided by Pelosi, who said months ago, during a fact-finding mission to Asia with other lawmakers, that she was “trying to get to yes” on the president’s trade deal. In 2009 and 2010, Obama leaned heavily on her, when she was the House speaker, to help wrestle the Affordable Care Act through Congress with Democratic majorities on a party-line vote.
As the trade vote neared, Pelosi refused to tip her hand, although she appeared to be working with Speaker John A. Boehner (R-Ohio) to schedule a package of related trade bills in a way to help them pass the House, even if she didn’t support them.
On Friday, taking the floor minutes before the vote, Pelosi broke her silence: “I will be voting to slow down fast-track,” she declared. “Today, we have an opportunity to slow down. Whatever the deal is with other countries, we want a better deal for American workers.”
It was a fatal blow for Obama, and supportive Democrats were stunned.
“She screwed this president,” one lawmaker fumed, speaking on condition of anonymity out of fear of retaliation. “She pandered to the left. She does not ever want to be outflanked by the left because that’s her base.”
The minority leader had heeded her center of power, while the president was left wondering where his had gone.

Feds Eye Link to Private Contractor in Massive Government Hack

The hackers who recently launched a massive cyber-attack on the U.S. government, exposing sensitive information of millions of federal workers and millions of others, may have used information stolen from a private government contractor to break into federal systems, according to sources briefed on the matter.
Authorities suspect the hackers, likely from China, entered the U.S. Office of Personnel Management’s computer systems after first gaining access last year to the systems of KeyPoint Government Solutions -- one of the primary providers of background checks for the U.S. government, sources said.
KeyPoint representatives contacted by ABC News declined comment for this story.
Authorities, meanwhile, believe hackers were able to extract electronic credentials or other information from within KeyPoint's systems and somehow use them to help unlock OPM's systems, according to sources.
The hackers then rummaged through separate "segments" of OPM's systems, potentially compromising personal information of not only the 4 million current and former federal employees already acknowledged publicly but also millions more, including relatives, friends and maybe even college roommates, the sources said.
In an unrelated statement today, OPM said authorities have "a high degree of confidence that OPM systems containing information related to the background investigations of current, former, and prospective Federal government employees, and those for whom a federal background investigation was conducted, may have been exfiltrated," as previously reported by ABC News.
The fact that Colorado-based KeyPoint suffered a cyber intrusion was well-publicized late last year. But the scope of the hack may not have been completely understood at the time by even the nation’s top cyber officials, sources indicated. Last year's incident has yet to be officially tied to the recent OPM hack.
The KeyPoint incident, mostly affecting employees of the Department of Homeland Security, was first detected in September, and two months ago DHS began notifying federal employees whose personal information "may have been compromised."
The notification was clear about what information was exposed: "[Your] first and last name, social security number, job title, investigation case number, education history, criminal history, and employment history; spouse or cohabitant’s name, date of birth, and social security number; the names, addresses, and dates of birth of relatives of the investigation subject; and names and addresses of friends of the investigation subject."
DHS discovered the KeyPoint intrusion only after undertaking a thorough assessment of all such contractors -- a move prompted by the hacking of another federal contractor, according to DHS.
Asked why the government waited seven months to notify potential victims, one U.S. official said it took time for authorities to conclude personal information may have been stolen in the incident.
Nevertheless, KeyPoint put in place "additional safeguards" after the intrusion was detected, and those steps should "prevent future incidents of this nature," according to the government notification.
In addition to the KeyPoint incident, investigators are also looking into whether another previously-known hack into OPM databases in March 2014 may be connected to the most recent breach.
That attack targeted an OPM system maintaining security clearance information. An OPM official, however, recently told lawmakers it didn’t expose any personal information.
Nevertheless, officials strongly suspect the cyber-attack came from China -- just like officials believe the most recent intrusion also came from China.
The most recent OPM hack is believed to have been far deeper and potentially more problematic than publicly acknowledged, sources said, with the hackers believed to have been moving in and out of government databases undetected for more than a year.
Much of the compromised data has been stored on OPM systems housed by the Department of the Interior in a Denver-area data center, sources said. And one of the "segments" compromised held forms filled out by federal employees seeking security clearances.
The 127-page forms -- known as SF-86's and used for background investigations -- require applicants to provide personal information not only about themselves but also relatives, friends and “associates” spanning several years. The forms also ask applicants if they have "illegally used a drug or controlled substance," and they require information on financial history and personal relationships.
That type of information, sources said, could be exploited to conduct "social-engineering" operations, potentially using the data to pressure or trick employees into further compromising their agencies.
Also of concern are U.S. employees stationed overseas, including in countries such as China, whose government would covet personal information on relatives and contacts of American officials living in the communist country, according to officials.
"If the SF-86's associated with this hack were, in their entirety, part of the stolen information, then that would mean the potential release of a staggering amount of information, affecting an exponential amount of people," one U.S. official told ABC News on Sunday.
Acting as the government's human resources division, OPM conducts about 90 percent of background investigations for the federal government. Information from SF-86 forms dating back three decades could have been exposed in the cyber-attack, sources said.
It's still unclear exactly what was compromised by the OPM hack, particularly because OPM officials and other authorities still don't have a good handle on how much information was actually stored by OPM in the first place, one U.S. official said.
Nearly 50 government agencies send data to OPM for storage in some form, according to the official.
The intrusion was only noticed after OPM began to upgrade its equipment and systems. As soon as anomalies within the systems were noticed, the Department of Homeland Security and FBI were notified.
Over two weeks, OPM will be sending notifications to the estimated 4 million current and former government employees whose "Personally Identifiable Information" may have been compromised by the hack.
And "since the investigation is ongoing, additional PII exposures may come to light," an OPM official acknowledged Sunday. "In that case, OPM will conduct additional notifications as necessary."
In a statement last week, an FBI spokesman said, "We take all potential threats to public and private sector systems seriously, and will continue to investigate and hold accountable those who pose a threat in cyberspace."
Efforts to reach an OPM spokesman today were unsuccessful.

Newly disclosed hack got ‘crown jewels’ - David Perera and Joseph Marks

Hackers have breached a database containing a wealth of sensitive information from federal employees’ security background checks, the Obama administration said Friday — news that experts say could deal a devastating blow to U.S. intelligence gathering.
The revelations came just a week after officials disclosed a previous massive cyber intrusion into the same federal personnel office, compromising records of more than 4 million current and past employees in a breach that administration officials have privately blamed on Chinese hackers.

The stolen records in the hack disclosed Friday included data on intelligence and military personnel, The Associated Press reported. A senior administration official would not confirm that information but confirmed that the breach occurred at the Office of Personnel Management.
The hackers are believed to have obtained data from a security intake form known as a Standard Form-86, which includes details such as financial trouble, past convictions, drug use and close relationships with citizens of other countries. The form is used for background checks of current, former and prospective federal employees.
“This is crown jewels material … a gold mine for a foreign intelligence service,” said Joel Brenner, a former NSA senior counsel.
The SF-86 breach could have dire consequences for U.S. intelligence gathering, former officials said, noting that it would make it extremely difficult for anyone inside the database to ever work in a covert capacity. For example, that would include someone employed by the State or Agriculture departments who gathers intelligence for the Defense Intelligence Agency.
“This is not the end of American human intelligence, but it’s a significant blow,” Brenner said.
As of October, 4.5 million Americans were cleared for access to classified information, including approximately a million contractors.
And because the SF-86s are stored in an indexed database, that database could also be combed for secrets, said Robert Caruso, a former Navy special security officer who has worked in security at the State and Defense departments. For example, Chinese agents could search the database for instances when agents with NSA covers were in the same place at the same time and make reasonable deductions about what they were doing there.
Brenner and Caruso both said it’s likely that clearance forms from the Defense Department and its related intelligence agencies, including NSA and the Defense Intelligence Agency, could be accessed through OPM. It’s much less likely that CIA employee clearance information was accessed that way because the CIA has traditionally insisted on managing its own personnel information.
“CIA refuses to put its people’s information in with OPM, and of course they’re right,” Brenner said. One lesson to draw from the breach, he said, is that “any serious clandestine agency has to be in charge of its own personnel information. Full stop.”
Investigators became aware of this second breach of the OPM’s systems as they pursued a previously disclosed breach into an unencrypted system holding personnel files of as many as 4.2 million current and past federal employees. That information included Social Security numbers, as well as names, addresses, pay grades, personnel actions and pension, insurance and health plan details.
The administration official said the relevant federal agencies received notification of the latest hack on Monday. “We expect OPM will conduct additional notifications as necessary,” the official said in a statement.
Administration officials have said privately that signs point to the first hack having originated in China, and security experts have said it appeared to be part of a Chinese effort to build dossiers on federal employees who might be approached later for espionage purposes.
Friday’s new revelations appeared to back up that theory.
The SF-86 “gives you any kind of information that might be a threat to [the employees’] security clearance,” said Jeff Neal, a former Department of Homeland Security official and a senior vice president at ICF International. “It’s really a personal document.”
It’s likely that the hackers are building a database on federal employees to “make it easier for them to try to pick off people that they want,” he added, saying most Americans who end up spying for foreign governments are motivated by money. With the security clearance data, plus the data from their earlier OPM hack, the attackers can compile lists of attractive and vulnerable intelligence targets.
Previously revealed data breaches at U.S. health insurance companies, which have also been attributed to Chinese state actors, only compound the accuracy of such a database, Neal said. “They can basically build a large record on federal employees.”
One federal cybersecurity official said the stolen data go beyond just the information on the employees themselves.
“They got more than just your security form,” the official said, speaking on condition of background. “They got the supporting documentation.”
Attackers also have information not just on federal employees with security clearances, but also any contact information that those cleared personnel entered into the form. “How deep is the personally identifying information on the other people, I don’t know,” the official said. “It might just be their contact information, and I think that’s what [investigators are] trying to find out.”
The disclosures add concern about employees being blackmailed or co-opted by foreign governments, former officials said.
Security clearance investigations, by their very nature, expose people’s darkest secrets — the things a foreign government might use to blackmail or compromise them such as drug and alcohol abuse, legal and financial troubles and romantic entanglements.
The best solution at this point, former officials said, may be what the government has already begun to do — drastically ramping up the government’s network defenses, both to prevent additional breaches from abroad and to more readily spot mischief by co-opted employees.
There may also be calls to further expand “insider threat” detection efforts, Caruso suggested.
Since the Chelsea Manning and Edward Snowden leaks that disclosed a wealth of classified data, the Defense Department and intelligence agencies have put increased emphasis on programs to continuously monitor some employees’ computer activity to spot anomalies — such as a China analyst accessing documents on Iran after hours. On a smaller scale, they’ve also ramped up “continuous evaluation programs,” which monitor public databases to turn up information suggesting added stress or abnormal behavior, such as financial troubles or an unreported drunken driving arrest.
Also on Friday, the White House announced a “30-day Cybersecurity Sprint” in which the administration is instructing agencies to take actions such as testing their networks’ vulnerabilities, patching weaknesses, restricting the number of privileged user accounts and “dramatically” ramping up the use of so-called multifactor authentication, which goes beyond requiring people to use passwords. In addition, a “Cybersecurity Sprint Team” will engage in a 30-day review of federal cyber efforts.

Costs Rise for US in Battle Against IS

U.S. officials have used many words to describe the terror group known as Islamic State, including "brutal," "nimble" and "resilient."
As the United States approaches the one-year anniversary of the start of airstrikes against Islamic State, officials may also need to add the word "costly."
According to numbers released this week by the Defense Department, the U.S. has spent $2.74 billion on counter-IS operations between August 8, 2014, and June 4, 2015, for an average of $9.1 million a day.
The U.S. Air Force has incurred the vast majority of the cost, 67 percent, followed by the Navy at 16 percent.
More than half of the cost, about $1.5 billion, has gone toward keeping U.S. planes in the air, with another $646 million going toward munitions.
Average Daily Cost for the U.S. of the Fight Against Islamic State
The Pentagon considers it money well spent, noting Islamic State has been rolled back from 25 percent of the territory it once held and that key cities and towns, like Tikrit, Sinjar, Amerli and Kobani, have been taken back with the help of U.S. air support.
“We have disrupted much of their [Islamic State’s] command and control,” said spokesman Colonel Steve Warren. “We have significantly eroded their ability to generate revenue.”
“All of this demonstrates that what we’ve been doing has been successful,” he said.
Still, a closer look at the numbers has some concerned.
'Mission creep'
“I think there will continue to be a gradual growth in the daily cost, because we are in the midst of what is called mission creep,” said Loren Thompson, a defense analyst with the Lexington Institute. “It’s awfully hard to say whether the money is being well spent without a clear articulation by the Obama administration as to what its goals are.”
According to the Pentagon’s own numbers, the average daily cost at the start of the U.S. air campaign was $5.6 million. But since President Barack Obama decided to expand the air campaign into Syria, the average daily cost of counter-IS operations has been $9.7 million.
Not all of the costs associated with the U.S. effort to degrade and ultimately destroy the Islamic State are reflected in the latest Pentagon numbers. For example, the figures do not include the cost of the administration’s $1.6 billion train-and-equip program for Iraqi forces.
Nor do the numbers reflect the cost of preparing and then operating the Taqaddum Air Base in Anbar province, which will be the base of operations for 450 U.S. military personnel tasked with advising Iraqi forces to help improve their “operational planning and execution.”
“Little by little, that range of activities and the number of participants is growing,” Thompson said.
No more bases planned
U.S. Central Command said Friday that there were no plans for more bases like the one soon to be established at Taqaddum, but it refused to rule out the possibility that could change.
“We’re always looking at ways we could best support them [the Iraqis],” said CENTCOM spokesman Colonel Pat Ryder. “Naturally, this could include additional venues going forward if requested by the Iraqis and our senior leaders assess that it makes good operational sense.”
Despite the expansion of U.S. operations in Iraq, U.S. defense officials reject the notion of any “mission creep.”
“This is a continuation of the mission we declared from day one,” Warren said, calling the strategy of using air power and support for Iraqi ground forces to ultimately defeat the Islamic State “crystal clear.”
Defense officials have said repeatedly that they expect it will take at least three years to destroy the Islamic State group. If the average cost of counter-IS operations stays the same, the price tag at the end of three years will be just shy of $10 billion.

Documents show bitter CIA dispute over pre-9/11 performance

WASHINGTON Top CIA officials fought bitterly in the years after the Sept. 11, 2001 attacks over whether U.S. intelligence agencies could have done more to stop the deadliest terrorist strikes in American history, documents released on Friday show.
The once-secret documents include a more complete version of a 2005 report by the spy agency's inspector general, which found that the CIA did not have a comprehensive strategy or marshal adequate resources to combat al Qaeda before hijacked planes hit New York's World Trade Center and the Pentagon on 9/11.
A redacted summary of that report was first made public in 2007.
But the documents released by the CIA on Friday also reflect the arguments of former CIA Director George Tenet and his lieutenants that U.S. intelligence was intently focused on al Qaeda and leader Osama bin Laden.
At stake in the years-long dispute are the legacies of former top CIA officials and the agency itself.
None of the documents focus directly on how President George W. Bush and his White House dealt with the al Qaeda threat after taking office in January 2001. Some former officials, including Bush counter-terrorism czar Richard Clarke, have said Bush did not initially make al Qaeda a priority.
In a heated June 2005 letter to then CIA Inspector General John Helgerson, Tenet rejected Helgerson's critical draft report.
"Your report challenges my professionalism, diligence and skill in leading the men and women of U.S. intelligence in countering terrorism," Tenet told Helgerson.
"I did everything I could to inform, warn and motivate action to prevent harm," he wrote. "Your report does not fairly or accurately portray my actions, or the heroic work of the men and women of the Intelligence Community."
After the bombings of U.S. Embassies in East Africa in 1998 and the USS Cole in October 2000, Tenet said, he warned President Bill Clinton "to expect from five to fifteen attacks against United States' interests."
Tenet has previously said that he developed a plan to go after al Qaeda in 1999, and worked to increase U.S. intelligence funding, slashed during the 1990s.
"I said when the executive summary was made public eight years ago that the IG’s report was flat wrong," Tenet said on Friday. "Nothing in the additional material just released changes that judgment in the slightest."
The documents, which former CIA officials pressed the agency to release, include a July 2005 memo from 17 top officers of the CIA's Counterterrorism Center disputing Helgerson's report.
Helgerson was not immediately available for comment.

Clinton Prison Worker Close to Escaped Convicts Is Arrested

CADYVILLE, N.Y. — A prison worker who befriended two killers before they escaped from a maximum-security prison in far northern New York State was arrested on Friday for providing them with “material assistance,” the authorities said.
The worker, Joyce Mitchell, 51, was charged with promoting prison contraband in the first degree, a felony, and criminal facilitation in the fourth degree, a misdemeanor. Her arrest came days after law enforcement officials said she had been cooperating with them and offering information that could be helpful in the hunt for the escapees.
The two men remained on the run on Friday, nearly a week after drilling their way out of the Clinton Correctional Facility in Dannemora, N.Y., in an elaborate escape plan.
Ms. Mitchell, a civilian employee at the prison, had been under surveillance after being identified by the authorities soon after the escape as a possible accomplice. She had sought hospitalization at about the same time as the escape, complaining of a panic attack, the authorities said.
The prisoners used power tools and subterfuge.

Andrew M. Wylie, the Clinton County district attorney, said on Friday that Ms. Mitchell had been speaking regularly with his office in recent days.
“We’re continuing to work with her, learning more and more information each day from her as far as establishing a timeline, how this process occurred and what her involvement was,” Mr. Wylie said, adding that while information was initially minimal, she had become more forthcoming as to “what her relationships were” with the killers.
“And from that we’re just developing leads we continue to investigate,” he added.
Mr. Wylie said on Friday that published reports that Ms. Mitchell had smuggled electrical grinders or other equipment to the inmates were false — “She has not brought power tools into the facility,” he said — and other investigators concurred.
The fugitives, Richard W. Matt, 48, and David Sweat, 34, escaped late last Friday night or early Saturday morning through holes that had been cut in the walls of their cells. They crawled to freedom through a hole that had been cut in the side of a two-foot steel pipe than ran beneath the prison’s walls.
Mr. Wylie said that Ms. Mitchell, who lives in Dickinson Corner, N.Y., a town about 60 miles west of here, had smuggled contraband into the prison. He would not provide additional details, noting that contraband can include a wide range of items.
“It wasn’t cocaine,” he said. “And it wasn’t toothpaste.”
Mr. Wylie also confirmed that Ms. Mitchell had been the subject of an investigation before the escape about whether she had become too close to Mr. Matt and Mr. Sweat.
“There wasn’t sufficient information to either lock her out of the facility” or have any discipline levied against her, he said.
But, he added, “action was taken to separate” Ms. Mitchell from one or both of the inmates “for a period of time.”
Investigators have also been looking into whether other prison staff members and corrections officers might have played a role in the escape, several people with knowledge of the inquiry said on Friday.
