In a letter Tuesday to FBI Director James Comey, the commitee’s Republican chairman and senior Democrat voiced “grave concerns” about recent revelations concerning erroneous lab results and inaccurate testimony involving microscopic hair analyses.
“The scope of this catastrophe is almost impossible to believe,” wrote Rep. Jason Chaffetz, R-Utah, and Rep. Elijah E. Cummings, D-Md., adding that the recent discoveries are “shocking and obviously unacceptable.”
The two lawmakers asked Comey for a briefing by May 22, pressing seven separate questions from when the Bureau first learned of the lab problems to what disciplinary actions, if any, have been taken against the lab examiners.
The committee’s oversight actions follow up on the revelations last month that examiners’ testimony in at least 90 percent of trial transcripts the Bureau analyzed as part of its Microscopic Hair Comparison Analysis Review contained erroneous statements. Twenty-six of 28 FBI analysts provided either testimony with erroneous statements or submitted laboratory reports with erroneous statements.
“We need to understand more about these cases,” Chaffetz and Cummings wrote.
In a statement last month, Amy Hess, the executive assistant director of the FBI’s Science and Technology Branch stressed that the Justice Department and the FBI are “committed to ensuring that affected defendants are notified of past errors and that justice is done in every instance.”

Police say they didn't see FBI bulletin before Texas attack

GARLAND, Texas (AP) — Hours before two would-be terrorists attacked a provocative Prophet Muhammad cartoon contest, the FBI sent local authorities the license plate number and photo of one of the shooters, who had a prior terrorism-related conviction, but police said Monday they didn't see the intelligence bulletin in time.
Garland Police Chief Mitch Bates also said the FBI notice was not specific enough to have altered authorities' response.
About 40 Garland police officers, along with members of federal and state law enforcement agencies, were guarding the May 3 event at a conference center in suburban Dallas when the attackers drove up and opened fire. Five officers responded, killing the two gunmen. One unarmed security guard was injured; no one attending the event was hurt.
Bates described the security plan, which he said took several months to create, as "an overwhelming success."

The FBI sent the bulletin through its Dallas command post to Garland police, informing them that one of the attackers, Elton Simpson, "might be interested in going to Garland," FBI Director James Comey told reporters in Washington on Thursday. An FBI spokeswoman in Dallas made the transcript of Comey's comments available Monday.
But Bates said no one at the law enforcement command post was aware of the FBI's bulletin on Simpson prior to the attack.
"We had no information from the FBI or anyone else that Simpson posed a threat to our event," he said.
The FBI memo was sent to the North Texas Joint Terrorism Task Force, a 24-agency organization that includes one Garland police detective, Bates said. That detective, who received the bulletin via email, didn't see it until after the event.
The police chief described the bulletin as "one of many emails sent on that day," and his spokesman said Bates had no access to it.
The FBI routinely disseminates information about potential national security concerns to local law enforcement officials, including members of joint terrorism task forces and regional locally operated fusion centers. In this case, the FBI flagged individuals — including Simpson — who it thought were interested in the cartoon contest.
Simpson and the other gunman, Nadir Soofi, were armed with three pistols, three assault rifles and hundreds of rounds of ammunition, Bates said Monday. The firefight happened outside the Curtis Culwell Center in Garland where the contest was held.
Neither the FBI nor Garland police said they anticipated that either suspect would target the event. And Bates added: "Please note that the contents of that email would not have prevented this shooting, nor would it have changed the law enforcement response in any fashion."
Federal and local law enforcement officials declined to provide The Associated Press with a copy of the FBI's May 3 intelligence bulletin.
Zach Horn, a Dallas attorney representing five officers involved in the shooting, said neither he nor his clients had seen the FBI memo. But, he added, "They knew they weren't guarding a Girl Scout convention."
Mainstream Islamic tradition holds that any physical depiction of the Prophet Muhammad is blasphemous, and drawings such as the ones featured at the Garland have sparked violence around the world.
The officers, all of whom remain on paid administrative leave, are members of the Texas Municipal Police Association. The union provides legal representation for police in officer-involved shootings.
The Garland school board, which owns the publicly funded Curtis Culwell Center, said Monday it will discuss arming its security personnel and will evaluate its leasing policy. In January, the center opened its doors to a fundraiser organized by a Chicago-based nonprofit that aims to help Muslims combat negative depictions of the prophet. That event drew about 1,000 protesters.

FBI hair analysis problems reveal limits of forensic science

WASHINGTON (AP) — Kirk Odom was convicted of a 1981 rape and robbery after a woman identified him as her attacker and an FBI specialist testified that hair on her nightgown was similar to hair on Odom's head.
But DNA testing some 30 years later affirmed what Odom long had maintained: The hair wasn't his; neither was the semen left on a pillowcase and robe. A felony conviction that imprisoned him for decades was overturned in 2012 by a judge who declared it a "grave miscarriage of justice."
"I was hoping that I was going to go home that day," Odom, recalling his trial in Washington, D.C., said in an interview. Instead, "they sentenced me to 20 to 66 years in prison."
His experience is but one example of flawed forensic science from the pre-DNA era, a simmering problem that now appears far more widespread than initially thought. The Innocence Project, which works to exonerate the wrongly accused, has identified 74 overturned convictions in which faulty hair evidence was a factor. Now, a new disclosure by the FBI that experts gave erroneous testimony on hair analysis in more than 250 trials before 2000 suggests that number could rise dramatically.
Defense lawyers say the latest revelations — on top of established concerns about bite mark identification and arson science — confirm fears about the shortcomings of old-fashioned forensic techniques and could affect thousands of cases. Advancing technologies have put such techniques under more scrutiny, including from judges, and highlighted the limits of once-established practices.
"There are forces converging at the moment that are finally bringing some recognition to the failings of many venerable techniques," said Chris Fabricant, director of strategic litigation at the Innocence Project.
A 2013 Associated Press investigation concluded that at least 24 men convicted or charged with murder or rape based on bite-mark evidence — the practice of matching teeth to a flesh wound — were exonerated since 2000. Meanwhile, some high-profile criminal cases involving arson science have come under renewed scrutiny amid debunked fire investigations. Last year, a Pennsylvania judge threw out the conviction of a Korean immigrant who had spent 24 years in prison for his daughter's death.
When subjective speculation is injected into a trial under the guise of science, "then a real perversion of justice is what happens," Fabricant said.
Microscopic hair analysis, which involves comparing hair specimens through a microscope, has for decades been an established FBI practice and passed along at seminars to hundreds of state-level examiners.
But critics say the technique lacks objective standards, with limitations that have led experts to overstate its evidentiary value too often.
Though this kind of evidence may be used to include or exclude individuals who could be a potential source of hair, critics note that there's no way to conclusively know how common or rare the specimen is because no national database of hair specimens exists. A 2009 report from the National Academy of Sciences described as "highly unreliable" testimony purporting to identify a particular defendant through hair analysis.
The FBI still considers microscopic hair analysis valid, but has also acknowledged its scientific limitations and uses it now in conjunction with more scientifically reliable DNA testing.
The Justice Department in 2012 embarked on a review of criminal cases following high-profile exonerations in which microscopic hair analysis was used. The government has identified nearly 3,000 cases in which FBI examiners submitted reports or may have testified in trials involving hair analysis.

ESPN’s investigative newsmagazine show, E:60, debuted an hour-long documentary on Blatter tonight, and reports that he is so fearful of an FBI investigation into bribery and corruption during the bidding process that he has decided not to step foot on U.S. soil:

CNN reported last November—after FIFA’s own investigation found no reason to take the World Cup’s away from Russia or Qatar—that the FBI’s three-year-old probe would continue:
A U.S. law enforcement official said the probe is looking at a variety of alleged corruption issues, including the 2018 and 2022 bidding process.
The FBI investigation includes the cooperation of a former top FIFA official who has provided documents and recordings of meetings with colleagues, law enforcement officials said.
Both CNN and E:60 report that an unnamed former FIFA official, likely Chuck Blazer, is assisting the investigation. Blazer was on the FIFA Executive Committee from 1996 to 2013, and was himself the subject of an FBI probe before he flipped, at least according to the New York Daily News.
Last summer E:60 debuted a documentary on the conditions faced by workers building World Cup stadiums in Qatar. Jeremy Schaap and an E:60 team went to Qatar, and the video they took and stories they heard were absolutely brutal. They snuck into a migrant camp where they documented the absolute squalor the workers live in—eight or ten to a room, cooking in overcrowded and filthy kitchens—and heard the stories of workers who cannot leave Qatar because their “employer” possesses their passport.
By choosing Qatar’s $200 billion World Cup bid over many others’s, including the United States’s, FIFA helped worsen an already terrible situation. Migrant workers were already streaming into Qatar to build fantastic monuments to oil wealth and living in near-slavery conditions, but the need to build a dozen stadiums and the infrastructure to support the World Cup has subjected hundreds of thousands more to them. As E:60 reported, Qatar essentially lies to these workers about the job to entice them to leave behind their families and countries in an attempt to better their lives, and then traps them once they get there.

North Las Vegas police ask FBI to investigate inappropriate images on mayor's computer

North Las Vegas police asked the FBI Tuesday to take over an investigation of how Mayor John Lee obtained images on his computer that he suspected showed child pornography.
The city’s new police chief, Alexander Perez, decided to seek federal help after reviewing how detectives handled Lee’s request last October to clear images from his iPad, police officer Aaron Petty said.
FBI Las Vegas spokeswoman Bridget Pappas said she had no immediate information about a request for bureau involvement.
The developments came after the Las Vegas Review-Journal reported Friday that a detective discovered web-browser links on Lee’s computer to at least one website displaying possible child pornography originating from a foreign country.
The paper said the Oct. 30 investigation ended after one day because the detective could not immediately verify the age or identify the location of the children. Lee’s other devices were not examined.
The news report came a day after Joseph Chronister retired as police chief and Perez, his former assistant chief, was promoted.
Lee told the Review-Journal the images began popping up on his computer after someone sent him an email, and he contacted police because he was worried they showed children being harmed.
Chronister, who retired as North Las Vegas police chief after more than 25 years in the department, told the newspaper he wished he had taken the findings of the police investigation to the Clark County district attorney and that the probe had been more complete.

FBI — Leader of Drug Trafficking Organization Admits Conspiring to Sell Kilograms of Heroin in New Jersey

TRENTON, NJ—A leader of a large-scale drug trafficking organization today admitted conspiring to distribute heroin in Ocean and Monmouth counties and elsewhere in New Jersey, U.S. Attorney Paul J. Fishman announced.
Rufus Young, a/k/a “Equan,” a/k/a “E-Money,” of Asbury Park, New Jersey, pleaded guilty before U.S. District Judge Peter G. Sheridan in Trenton federal court to an information charging him with conspiring to distribute 100 grams or more of heroin.
In March 2014, 19 other alleged members of the drug trafficking organization of which Young was a leader were charged by criminal complaint with conspiring to distribute heroin. The complaint referred to the drug trafficking organization as the “Britt-Young DTO,” after its leaders, Young and Robert Britt, a/k/a “True.” Of those 19 individuals, 14 have pleaded guilty.
According to documents filed in this case and statements made in court:
Between February 2013 and March 2014, Young conspired with others to distribute heroin in Ocean and Monmouth counties as part of the Britt-Young DTO. Young was a leader of the organization and was responsible for, among other things, supplying heroin to various sub-dealers who distributed the heroin to others. To carry out Britt-Young DTO’s drug trafficking business, Young maintained several stash house locations that he and his conspirators used to package, store and sell heroin, including a recording studio in Toms River and two apartments in Neptune, New Jersey. Young was responsible for distributing between one and three kilograms of heroin during the conspiracy.
The narcotics conspiracy charge to which Young pleaded carries a maximum penalty of 40 years in prison and a $5 million fine. Sentencing is scheduled for Aug. 19, 2015.
U.S. Attorney Fishman credited special agents of the FBI, Red Bank Resident Office, under the direction of Special Agent in Charge Richard M. Frankel; officers of the Brick Township Police Department, under the direction of Chief Nils R. Bergquist: and officers of the Toms River Police Department, under the direction of Chief Mitchell Little, with the investigation. He additionally credited special agents of the Bureau of Alcohol Tobacco Firearms and Explosives, under the direction of Special Agent in Charge George P. Belsky; inspectors of the U.S. Postal Inspection Service, under the direction of Inspector in Charge Maria L. Kelokates; officers of the Monmouth County Prosecutor’s Office, under the direction of Acting Prosecutor Christopher J. Gramiccioni; and officers of the Ocean County Prosecutor’s Office, under the direction of Prosecutor Joseph D. Coronato. He also thanked the Monmouth County Sheriff’s Office and the Neptune Township, Asbury Park, Marlboro, Long Branch and Freehold police departments for their roles in the case.
The government is represented by Assistant U.S. Attorney Nicholas Grippo of the U.S. Attorney’s Office Criminal Division in Newark.

FBI delivers on $1.1B biometrics program

The FBI added a host of new capabilities for federal and local law enforcement officials to improve how they identify suspects. The Next Generation Identification System replaced a 15-year-old fingerprint system with advanced biometrics.
But it wasn't just the facial recognition or the move from two fingerprints to 10 fingerprints or the huge improvements around identifying latent fingerprints. The FBI actually delivered this $1.1 billion program on-time, on-budget and within expected capabilities, and turned off the 1990s-era Integrated Automated Fingerprint Identification System (IAFIS).
"It was a quite a feat. It was actually a 10-year program with six years of contract work. Increments we decided were the best way to deliver functionality each year. We can make sure we have something out there," said Jim Preaskorn, the program manager for the FBI's next generation identification system, in an interview with Federal News Radio after the AFCEA Bethesda's 8th Annual Governmentwide Initiatives Excellence Awards in Washington. "As for the cost and schedule, it was a team effort. It was a $1.1 billion program, so we had a whole program office and that philosophy of earned value, schedule containment and quality as well as scope. Think of it as a three-legged stool, quality, cost and schedule, saw one off, you have to do something to the others."
The FBI hired Lockheed Martin in 2008 under a 10-year contract to implement NGI to replace IAFIS, which the bureau implemented in 1999.
The FBI and Lockheed began implementing new capabilities starting in 2011, with increment four going live in September 2014 to meet full operational capability.
It was that reason why AFCEA Bethesda honored Preaskorn and the FBI with the Excellence in Mission Award. In all, the organization honored federal and state IT executives in nine categories.
"You are being honored here today because you naturally aspire to and exhibit these ideals of excellence. You are being honored here today because you passionately and instinctively employ the attributes we have heard extolled," said Richard McKinney, the Transportation Department chief information officer, who gave the keynote speech at the awards ceremony. "You understand their meaning intuitively without needing a reminder from me or anyone else because you practice them every day. You work hard as a matter of habit. Your virtue and your excellence are the just rewards of that hard work and the cause for this celebration today."

Accuracy and speed
The FBI's hard work translated into significant more capabilities for federal, state and local law enforcement officers.
Preaskorn said NGI improved the accuracy of fingerprint algorithms to 99.6 percent from 92 percent. Officers now have access to the Repository for Individuals of Special Concern (RISC) through theirmobile devices.
"An officer can take one or two fingers and get images back to us and within six seconds or so, we will give a probable cause, red light or green light type of thing," he said. "We redid our latent and became three times more accurate. We went from about 26 percent accurate on our latent submissions to about 82 percent to 86 percent accurate."
Preaskorn said the IAFIS system didn't process flat or latent fingerprints as opposed to rolled fingerprints well.
Most recently under increment four, the FBI received facial recognition capabilities and a Rap Back services, which provides law enforcement officers notification of criminal, and, in limited cases, civil activity of individuals that occurs after the initial processing and retention of criminal or civil transactions.
"We take still images, which are mug shots and photos contributed by law enforcement, and we will return a candidate list and they will have a gallery to select from," Preaskorn said. "We also are scalable now. We built this on a service-oriented architecture so as a modality changes we can unplug in and plug in a new vendor, or expand if we want to add iris in the future. We can just plug it into the service-bus and it allows us to expand and grow."
Probably the biggest difference between the two systems is the FBI designed the IAFIS system for about 62,000 transactions a day. The bureau created NGI to handle as many as 700,000 transactions a day.
"We've actually hit 693,000 on April 16. It's not a typical day. The busy times are 260,000 or so," he said. "It's scalable, more flexible built on blade technology, increase core processing, add memory or change hardware at will."
Other feds using NGI
Preaskorn said by building NGI increments over the last few years, the FBI allowed field agents and other stakeholder to test and comment on the system. This ensured the FBI wouldn't suffer from scope creep and that it was meeting users' needs.
The FBI will continue evolving NGI over the next few years. Preaskorn said they are piloting iris technology to see if it's viable. He said the bureau also is considering DNA, voice or other modalities as those technologies improve.
The Next Generation Identification System isn't just for the FBI. Preaskorn said the Homeland Security Department is its biggest federal customer. DHS sends prints to NGI from all border crossings and port of entry checkpoints.

FBI Chief of Staff Tapped as Acting DEA Administrator

A former U.S. attorney and current chief of staff to the FBI director has been named acting director for the Drug Enforcement Administration, the Justice Department announced Wednesday.
Attorney General Loretta Lynch said Chuck Rosenberg will replace ousted DEA chief Michele Leonhart.
Leonhart, a career drug agent, was forced to retire last month amid questions about her handling of allegations of misconduct by agents outlined in an inspector general's report. The report included allegations that agents working in a foreign country attended sex parties with prostitutes. The DEA later confirmed that the country was Colombia. Twenty-two members of the House Oversight Committee, including 13 Democrats, signed a no-confidence statement after Leonhart testified about the report and allegations that the agents involved in misconduct received lenient punishments.
Rosenberg will take over on a temporary basis next week.
He previously served as U.S. Attorney from the Eastern District of Virginia and the Southern District of Texas under President George W. Bush. He is currently chief of staff to FBI Director James Comey.

PHILADELPHIA — The Amtrak train that derailed in Philadelphia on Tuesday night, killing at least seven people, was barreling through a sharp turn at 100 miles an hour or more, at least twice the speed limit on that stretch of track, according to the National Transportation Safety Board.
The train’s speed was recorded in the “black box” data recorders that were recovered from the wreckage, according to officials with knowledge of the investigation, while emergency crews searched for more survivors and victims of a wreck that injured more than 200 people.
The recorders were taken to Amtrak’s operations center in Delaware to download information like the train’s speed, images from a video camera on the engine and a log of when the train’s operator used tools like the brake, throttle and horn, officials said at a news conference.
Passengers who emerged battered and bloodied described a chaotic, terrifying scene, with people thrown against walls, furniture and each other, and luggage and other loose items flying through the air and hitting people.
The wreck occurred as the New York-bound train made a sharp left turn at a railyard called Frankford Junction northeast of Center City, where multiple freight and passenger routes converge and Amtrak’s Northeast Corridor makes one of its sharpest turns. The speed limit on that curve, in the Port Richmond section of the city, is 50 miles an hour, according to the Federal Railroad Administration, and on either side of the curve it is 70 m.p.h.
Robert Sumwalt, a safety board member, said during a news conference that the train was traveling 106 m.p.h. when the brakes were applied as the train was making a left-had curve.
Experts said the derailment might have been averted by a safety system called positive train control, that can, among other features, automatically reduce the speed of a train that is going too fast. To do that, the system must be installed on both the train and the route; the Amtrak train had it, but that stretch of track did not.
Railroads are under a congressional mandate to install the system on passenger routes and major freight lines by the end of the year, but they are seeking an extension because of the cost and complexity of the work. The Association of American Railroads said that operators have already spent $5 billion on positive train control, and still need to spend about the same amount to comply with the mandate.
Absence of positive train control was also cited as a factor in the fatal 2013 crash of a Metro-North train in the Bronx.
But even without the system, rail safety experts said Amtrak locomotives have multiple systems to alert train operators to excess speed, with warning lights and sound alarms.
“When you are depending entirely on a human being, the engineer in this case, then there is an opening for a human error and a tragedy like this one,” said Russ Quimby, a retired rail crash investigator with the safety board. “If you have no system to regulate the speed, then that’s the core failure.”
Mayor Michael A. Nutter of Philadelphia, at a news conference, refuted reports that the engineer who was driving the train had refused to speak to investigators. “The engineer was injured, received medical care, and was interviewed by the Philadelphia Police Department,” he said.
He confirmed reports that the death toll had reached seven, with more than 200 people injured, and said that for now, the focus of emergency crews combing through the twisted wreck was “making sure that we are searching every car, every inch, thousands of square feet, to find individuals that may have been on the train.”
“We are heartbroken at what has happened here,” he said. “We have not experienced anything like it in modern times.”
The names of the victims began to trickle out Wednesday afternoon. The United States Naval Academy confirmed that one of its midshipmen was among the dead, and family members identified him as Justin Zemser of Rockaway Beach, in Queens, a former student body president at Channel View High School.
“We’re not ready to talk yet. We are just grieving, and when we are ready we will be in touch,” said a relative, who did not want to be identified.
The Associated Press said that one of its employees, Jim Gaines, 48, a video software architect who lived in Plainsboro, N.J., was also killed.
Another victim was Rachel Jacobs, chief executive officer of ApprenNet, an education technology company in Philadelphia, whose co-workers spent most of the day Wednesday unsure of what had happened to her. A friend, Michelle Kedem, said she had received a text message from Ms. Jacobs’s family confirming her death.
Mr. Nutter said some passengers have not yet been found, but officials were still not sure how many. “We have not completely matched the manifest that we received from Amtrak with the patient or hospital records,” he said.
Investigators are trying to determine what caused a New York-bound Amtrak train to jump the tracks Tuesday night.

People trying to find loved ones congregated first at Philadelphia’s 30th Street Station, then at a temporary aid station the city set up at an elementary school, and finally at the Marriott Hotel downtown, where Amtrak opened a family center.
Philadelphia’s director of emergency management, Samantha Phillips, said, “Our hospitals treated over 200 patients last night and this morning.”
The train, Northeast Regional Train 188, from Washington to New York, was pulled by an ACS-64 electric locomotive built by Siemens, a model first put into service last year that is capable of speeds up to 125 miles per hour.
It jumped the tracks at about 9:30 p.m. Tuesday, tossing around the passengers and crew, as most of the train’s seven passenger cars tumbled onto their sides and crumpled. One car was particularly badly mangled, looking like nothing so much as a crushed and torn soda can. One car struck a steel utility pole, and a stretch of bent and twisted track could be seen near the wreckage, indicating the sheer force of the crash.
Passengers described a quiet ride turned suddenly chaotic and terrifying.
“The guy next to me was unconscious, so I just kind of picked him up and slapped him in the face and said ‘Hey buddy, get up, get up,’ and he came to,” said Patrick J. Murphy, a former congressman from Pennsylvania, who was on the train.
The engine pulling the train separated from the passenger cars, left the tracks, rumbled through a dirt area and came to rest diagonally across other sets of tracks.
After the crash, emergency workers carrying flashlights and ladders moved frantically from car to car helping passengers off the train, some bloodied, others dazed. Parts of the damaged cars were so badly mangled that firefighters had to use hydraulic tools to rescue people trapped inside.
Amtrak reported that 238 passengers and five crew members were supposed to be on the train, but officials cautioned that those figures were inexact; off-duty Amtrak employees could have been aboard without appearing on passenger manifests, and people who bought tickets might have missed the train.
Investigators from the National Transportation Safety Board began to arrive before 5 a.m., said Robert Sumwalt, a board member, adding that they may be able to release more information on Wednesday afternoon. The F.B.I. was also investigating.
On Wednesday, a giant crane moved into position and began attempting to lift the damaged cars. The wreck severed Amtrak’s Northeast Corridor, one of the nation’s busiest rail routes, and the Southeast Pennsylvania Transportation Authority’s commuter train line from Philadelphia to Trenton, stranding thousands of passengers and threatening to snarl travel for days or weeks to come.
Temple University Hospital received 54 patients from the wreck, including one who died overnight from a massive chest injury, Herbert E. Cushing, the chief medical officer, said Wednesday morning. He said that most of the patients suffered fractures from being thrown around the train, and that 25 remained in the hospital, including eight people in critical condition.
“There were lots of people from all around the world” among the injured, he said, including patients from Albania, India and Spain.
About 20 minutes before the crash, on the same line but a few miles away, “an unknown projectile” struck a SEPTA commuter train and damaged a window, an authority spokeswoman said. Mr. Nutter said that had “nothing to do with this incident.”
Amtrak service continued between Philadelphia and Washington on a modified schedule, but no trains were able to run between Philadelphia and New York.
The derailment took place in roughly the same area of track that was the site of one of the nation’s deadliest rail accidents. On Labor Day in 1943, a 16-car Pennsylvania Railroad Congressional Limited train carrying military service members on leave derailed near the same curve, killing 79 people and injuring 117.
Officials concluded that a hot journal box had burned off and caused an axle to snap, which sent the train catapulting off the track.
