Congressional Democrats Move to Institute New Jersey Style Gun Control

Congressional Democrats introduced a bill Thursday that would implement a more restrictive process for obtaining a handgun nation wide.
The bill, called the Handgun Purchaser Licensing Act of 2015, comes less than a week after a New Jersey woman was killed while waiting for approval to buy a handgun under similar restrictions. If enacted, the bill would require Americans attempting to buy a handgun “provide proof they are at least 21 years old and a lawful resident of the United States; apply for the license at a law enforcement agency within the state; submit to a background investigation and criminal history check; submit fingerprints and photographs with their application and be eligible to purchase a handgun pursuant to the Brady Handgun Violence Prevention Act,” according to a fact sheetpublished by Rep. Chris Van Hollen (D., Md).
Despite support from Sen. Richard Blumenthal (D., Conn), Sen. Chris Murphy (D., Conn), and Rep. Elizabeth Esty (D., Conn), the bill is unlikely to pass either the House of Representatives or the Senate.

Chinese hack compromised security-clearance database

The Chinese breach of the Office of Personnel Management network was wider than first acknowledged and officials said Friday that a database holding sensitive security clearance information on millions of federal employees and contractors also was compromised.
In an announcement, OPM said that investigators concluded earlier this week “there was a high degree of confidence” that the agency’s systems containing information related to the background investigations of “current, former and prospective” federal employees, and those for whom a background check was conducted, were breached.
OPM is still assessing how many people were affected, spokesman Samuel Schumach said. “Once we have conclusive information about the breach, we will announce a notification plan for individuals whose information is determined to have been compromised,” he said.
The announcement of the hack of the security clearance database comes a week after OPM disclosed that another personnel system had been compromised. The discovery of the first led investigators to find the second--all part of one campaign by the Chinese, evidently to obtain information valuable to counterespionage.
“This is potentially devastating from a counterintelligence point of view,” said Joel Brenner, a former top counterintelligence official for the U.S. government, speaking of the latest revelation. “These forums contain decades of personal information about people with clearances...which makes them easier to recruit for foreign espionage on behalf of a foreign country.”
Last week, OPM announced that a database containing the personal information of roughly 4 million current and former federal employees was hacked. Privately, U.S. officials said that the Chinese government was behind the breach.
The breach of that data system affected 4.1 million individuals--all 2.1 million current federal civilian employees and 2 million retired or former employees. Information on officials as senior as cabinet secretaries may have been breached. The president’s and vice-president’s data were not, officials said.
China has dismissed the hacking allegations, with a foreign ministry spokesman last week calling them “irresponsible and unscientific.”
The separate background check database contains sensitive information — called SF-86 data — that includes applicants’ financial histories and investment records, children’s and relatives’ names, foreign trips taken and contacts with foreign nationals, past residences and names of neighbors and close friends.
That database was also breached last year by the Chinese in a separate incident, and the new intrusion underscores how persistent and determined Beijing is in going after data valuable to counterespionage.
“The adversary is obviously very interested in that data,” said a U.S. official, who spoke on condition of anonymity because of the ongoing investigation.
The discovery of the second compromise was not exactly a surprise. “It’s like cancer,” said a second U.S. official. “Once you start operating on the cancer, you find it has spread to other areas of the body.”
Employees of intelligence agencies such as the CIA generally do not have their clearance checks records held by the OPM, though some do, officials said.
“That’s the open question--whether it’s going to hit CIA folks,” said the second official said. “It would be a huge deal. They could start unmasking identities.”
Matthew Olsen, a former National Security Agency general counsel and former head of the National Counterterrorism Center, said the breach is “truly significant.” The data can be used in many different ways to target people, “whether it’s blackmail, to recruit, to punish individuals in China who are connected to people in the United States.”
The Chinese government in the last year or two has begun building massive databases of Americans’ personal information obtained through cyber espionage. Besides the series of OPM intrusions, last year a federal government contractor that conducted background investigations for OPM and the Department of Homeland Security also were hacked by the Chinese. And Beijing has been linked to penetrations of several health insurance companies that hold personal data on tens of millions of Americans.
“Who can be surprised?” Brenner said. “They’re making a concerted effort to gather vast quantities of information about Americans. This is perfectly clear. That they have all this clearance information is a disaster.”
President Obama, as with previous high-profile breaches, has been briefed on the investigation. What steps if any the administration can or should take in response is a difficult discussion, current and former officials said.
“There are a whole array of things we need to do across the board from raising our defenses to making sure that this stuff isn’t actually on the criminal underground, to understanding the full scope” of the breach, the first official said. “We haven’t gotten there yet.”
What complicates this case is that unlike many other Chinese breaches of U.S. networks, the OPM hacks do not involve theft of commercial secrets. Last year, the United States indicted five Chinese military officials on charges of commercial cyber espionage. With traditional espionage, the options are fewer.
“You’re not going to start a shooting war over this,” said a former intelligence official.”We need to improve our defenses. We also want to go on the offense.”
Going on the offense might include directing a U.S. agency to locate the servers holding the stolen data and deleting or altering the data, the former official said.
The administration timed its announcement last week of the initial OPM breach to comply with its own policy, as reflected in proposed legislation, to notify individuals of a breach within 30 days of concluding that there is a “reasonable basis to believe” that personal information has been compromised, the first U.S. official said.
Though the breach was discovered in April, it was not until early May that investigators determined that employees’ personal likely was taken. That led to the announcement last week even though, the official said, the investigation was not complete.
During a briefing for Congressional staff last week, Ann Barron-Dicamillo, a senior DHS official, tried to explain the delay in alerting employees to the breach. “It takes time to do the forensics and to understand what’s happened, and even to understand what data, if any, has been exposed,” she said, according to notes taken by a Congressional aide.
The breach, she said, took place in December. “It took awhile to pinpoint what actually went out the door because it happened six months ago,” she said.

True to form, the CIA waited until 4:16 p.m. EDT this afternoon to release a trove of documents related to the September 11 attacks. Deep within one of those documents is a section on everything the agency learned after 9/11 about “Issues Relating to Saudi Arabia.” We can now share it here for the first time.
The Saudi Arabia findings comprise literally the final section, the last 30 pages, of the CIA’s massive, 495-page master report—completed in 2005 and never revealed before—on who was accountable for what intelligence failures in the September 11 attacks in New York, Washington and Pennsylvania. High-level Saudi involvement in the attacks has long been suggested by many parties in the know; several members of Congress and the 9/11 Commission have urged the release of a still-secret 28-page excerpt of the commission report, believed to detail connections between the House of Saud and the Al Qaeda hijackers. But the U.S.’s special security relationship with the Kingdom of Saudi Arabia, and its reliance on foreign oil, give the federal government incentives to keep that knowledge under wraps.

The report emphasized that the JI had made “no final determinations as to the reliability or sufficiency of the information” regarding Saudi Issues raised by its inquiry.
Assessment of the finding
Many of the points of this finding relate to the investigative efforts on the Saudi intelligence presence in the United States and of Saudi officials’ contacts with terrorists in the country, and, as such, the Office of Inspector General (OIG) 9/11 Review Team defers consideration of these to the Department of Justice and the FBI. The Team lacks access to the full range of investigative materials in FBI possession and is therefore unable to either concur or dissent on those points. In addition, the Team encountered no evidence that the Saudi Government knowingly and willingly supported al-Qa’ida terrorists. Individuals in both the Near East Division (NE) and the Counterterrorist Center [REDACTED] told the Team they had not seen any reliable reporting confirming Saudi Government involvement with and financial support for terrorism prior to 9/11, although a few also speculated that dissident sympathizers within the government may have aided al-Qa’ida. A January 1999 Directorate of Intelligence (DI) Office of Transnational Issues Intelligence Report on Bin Ladin’s finances indicated that “limited” reporting suggested that “a few Saudi Government officials” may support Usama Bin Ladin (UBL) but added that the reporting was “too sparse to determine with any accuracy” such support. Judiciary chairman presses FBI for details on remote cyber spying

Senate Judiciary Committee Chairman Chuck Grassley (R-Iowa) is pressing the FBI for more information about its attempts to expand remote electronic spying powers.
“Publicly available information on the FBI’s use of spyware is often inconsistent,” Grassley said. “It is unclear from public reporting which spyware programs the FBI currently uses and what their capabilities are.”

The Justice Department is trying to amend the Federal Rule of Criminal Procedure to give judges the power to authorize warrants for electronic searches in multiple jurisdictions or when investigators don’t know the physical location of a device.  
Under the current rules, judges can only grant warrants for their own jurisdictions, with some narrow exceptions.
Major tech players like Google, computer scientists and privacy advocates oppose the change, which they believe would give the FBI the authority to hack and spy computers with minimal oversight.
But officials have argue the change is simply a necessary technical one to help investigators in a digital age. Computer networks span multiple jurisdictions, and getting a warrant for each is a logistical nightmare. Additionally, it’s often difficult for law enforcement officers to identify a device's physical location.
“The procedures used by the FBI to obtain approval to deploy spyware … raise important issues,” Grassley said.
The lawmaker wants to know exactly when the bureau uses these search methods, pointing to several instances in which the FBI came under fire for its spying tactics.
Grassley referenced reports showing “the most common delivery method for installing the spyware is phishing attacks, in which the FBI masquerades as a trustworthy source in order to trick the target into clicking on a link infected with the spyware.”
“It is also unclear from public reporting whether the FBI uses other methods of spyware deployment in addition to phishing, such as zero-day exploits, which exploit vulnerabilities in legitimate software applications,” Grassley added.
Two little-known government panels have so far approved the change. But Congress can nix the proposal after the Supreme Court signs off.
“The [Judiciary] Committee needs more specific information about the FBI’s current use of spyware in order to fulfill its oversight responsibilities,” Grassley said.

CIA releases secret report identifying errors before 9/11

After a decade of secrecy, the CIA on Friday released a nearly 500-page inspector general report outlining multiple “systemic problems” in the nation's spy agencies ahead of the terror attacks on Sept. 11, 2001.
Those failures helped contribute to the country’s blindness about the terror attacks, analysts claimed in the 2005 report, and impeded the government’s work to track down Osama bin Laden and other top al Qaeda leaders in the years before 9/11.

Senior officers told the CIA’s Officer of Inspector General that “no comprehensive strategic plan” was ever developed to thwart bin Laden “at any time” before 9/11, despite years of warning and commitments to respond to the threat of al Qaeda.
The CIA’s release of the report late on Friday afternoon comes years after the agency initially declassified part of the document, and was prompted by Freedom of Information Act requests for the full critique. 
The spy agency watchdog specifically criticized George Tenet, the former head of the CIA who oversaw the agency for years before and after the 2001 attacks.
While Tenet “recognized the need for an integrated, interagency plan” to combat al Qaeda, he “bears ultimate responsibility for the fact that no such strategic plan was ever created, despite his specific direction that this should be done,” the report claimed.
The CIA said that it was releasing the document — along with two responses from Tenet and two additional views on the subject — “to further contribute to the public record on these events.”
“The events of 9/11 will be forever seared into the memories of all Americans who bore witness to the single greatest tragedy to befall our homeland in recent history,” the CIA said. “The documents released today reflect differing views formed roughly a decade ago within CIA about the Agency’s performance prior to 9/11.”
The CIA inspector general report was prompted by a joint report from the House and Senate Intelligence Committees more than a decade ago. When it was released in 2005, then-CIA Director Porter Goss said that he would decline to follow its recommendation to create an accountability board to review individual CIA officers.
The new documents show that Tenet vociferously denounced the inspector general’s report at the time.
In a June, 2005 letter, Tenet called the analysis “nonsense,” “simply in error,” “devoid of any information” from senior policy makers and said that it “ignores” key facts.
“Your report does not fairly or accurately portray my actions, or the heroic work of the men and women of the Intelligence Community,” he claimed. “It is simply not fair to make judgments about my performance without having a complete understanding of the facts.”
