M.N.: In his last, (self-de)crowning, defiant, symbolism imbued gesture, Mr. Holder 
"took the "Free Eric Holder" wristbands off his wrist and threw them into the audience", proclaiming himself to be "free" via this quite "self-affirmative", boastful and demonstrative exercise of the freedom of expression, which, many claim, is willfully denied to others by "the Obama Administration, ...the greatest enemy of press freedom in a generation". 

But is he re-ah-ah-ah-lly free, and why now? 
Apparently he did not feel so "free" prior to this act. And why not? 
Was this lack of freedom due to the shackles of racism, bias and preconceived (pseudo)ideological burdens  during his tenure and in his agenda

However, the assessments of these consequences do vary broadly:

Clearly, it’s not the Constitution that Eric Holder is safeguarding but the power of the presidency. Without a doubt, Holder has taken as his mantra Nixon’s mantra that “When the President does it, that means it is not illegal.” It may be that the time has come to create a “non-political” and “independent” Attorney General, one who would serve the interests of the public by upholding the rule of law rather than justifying the whims of the President."

Mr. Holder also turned Justice into a routine instrument of social and racial policy. Under the former head of the Civil Rights Division, Thomas Perez (now Secretary of Labor), Justice used "disparate impact" analysis to force racial adjustments on cities, police and fire departments and banks. The settlements were not based on proven racial discrimination, as traditionally required, but on arcane statistical analyses...  
In July 2012 the Attorney General invoked the specter of Jim Crow amid a presidential campaign. In a speech to the NAACP, he likened voter ID laws to "poll taxes," an argument rejected by the Supreme Court in 2009.
As a footnote, don't forget Mr. Holder's unprecedented investigations of journalists, such as Associated Press writers and Fox News reporter James Rosen, under the Espionage Act... 
We assume President Obama will nominate a successor who will continue the politicized Holder legacy. That subject deserves a full airing in Senate confirmation hearings. Should Eric Holder be prosecuted? - GS

The review below is laden with criticism, at times heavy, at times vicious and hateful. 
It is not for me to judge if this criticism is deserved or not, I do not know enough about him as a person, as a leader, as a lawyer and do not know enough about his work as AG. Apparently, other people do, if they felt obligated to offer their opinions. 

The "Advocate" exalts Mr. Holder for "making history by redefining what is both possible and necessary", apparently referring to LGBT Rights and gay marriage. One might argue that this "history" was much overdue and became "possible and necessary" in Europe more than a decade ago, calmly and naturally, without much "redefinitional" fanfares. 

"Attorney General Eric Holder, who has announced that he will step down, wants to be remembered for his record on civil rights. He will be—but not in the way that he means. From the standpoint of civil rights, historians will regard him as a failure.
...

This is not a record that a civil-rights-promoting attorney general can be proud of."

For me, the story of Mr. Holder's resignation developed into the broader set of questions and issues: 
How did it happen, that Obama's Presidency inherent promise of the "final resolution and healing" of racial conflicts turned into its direct opposite: the most politically and racially polarised and polarising administration

Mencken quipped that the "ironically so-called" Justice Department was in fact "a fecund source of oppression and corruption..." When will this healing come? The related questions would fill no less than three pages of the Google search headings and I am not sure that the adequate explanations could be found. This seemingly endless historical process of searching for answers goes on: every day, every Presidential term, every historical period. We are condemned to this search, because the knowledge of the mistakes and sins of the past does not enlighten us sufficiently; we still repeat them, turn them around in vengeance, play them out compulsively: the deep traumas never end. Will they ever heal?

His was the most divisive tenure of any attorney general I can recall, tearing the country apart on racial and partisan lines," said Ilya Shapiro, a senior fellow at the libertarian Cato Institute. "By not just pushing but breaking through the envelope of plausible legal argument, Attorney General Holder has done his all to expand federal (especially executive) power and contract individual liberty beyond any constitutional recognition. J. CHRISTIAN ADAMS: Core of Eric Holder's agenda was race

Alas, the Eric Holder era is over. But critics who think his departure means normalcy will return haven’t been paying attention. Mr. Holder was President Obama’s point man for fundamentally transforming the country, and he did his job well.
At the center of Mr. Holder’s transformative agenda was race. Race has always occupied Mr. Holder’s attention; he once said, “There’s a common cause that bonds the black United States attorney with the black criminal.”
In what could have been a presidency where race faded into America’s rear-view mirror, Mr. Holder turned race into the road map.
It all started in 2009 when I was at the Department of Justice. I witnessed a new way of looking at the law. To Mr. Holder and his newly empowered progressive lawyers, the law was a mere suggestion, not a constraining force.
When the Justice Department dismissed my voter intimidation case against the New Black Panther Party, it was the first inkling this was no ordinary attorney general. Worse yet, after the dismissal, Mr. Holder presided in meetings of Civil Rights Division managers cooking up plans to oust managers who dared to enforce civil rights laws against black defendants.
But the New Black Panther mess was just the beginning.
The Justice Department Civil Rights Division — something Mr. Holder explicitly said would be the focus of his tenure — became an engine of fundamental transformation. It became the taxpayer-fueled command center for the progressive left.
Radical policies, laughable just a decade ago, began to appear in the form of a federal fist.
When a New York high school prohibited boys from dressing like drag queens — wearing pink wigs and stiletto heels — Mr. Holder’s Justice Department forced the Mohawk Central School District to capitulate. Mr. Holder imposed $75,000 annual transvestite sensitivity training on the school for good measure.
Mr. Holder’s Civil Rights Division turned the Americans with Disabilities Act into a federal mandate forcing restaurants, hotels and other public accommodations into allowing miniature horses, pigs and ferrets in as emotional support animals.
When South Carolina and other states enacted photo voter identification laws, Mr. Holder sprang into action and turned the Justice Department into a base-mobilization organization for the president’s re-election in 2012.
Mr. Holder’s opposition to election integrity demonstrates the confluence of race and politics. He conjured all of the morally sacred language of the civil rights movement in the 1960s and employed it recklessly against voter ID.
He compared voter ID to a poll tax, even though courts had specifically rejected such a false comparison.
Just before Christmas in 2011, black voters were unexcited about Mr. Obama. So Mr. Holder launched a government-driven campaign against voter ID in South Carolina and activated a moribund political base for the president’s re-election. Without a racially polarized and activated base, Mr. Obama could not have won in 2012.
Mr. Holder was an attorney general not beyond using scare tactics against minorities to win re-election.

Eric Holder Sending Black Panthers To Steal All The Elections Again

The Department of Justice is sending federal monitors to observe elections in 18 states, and the Wingnuttosphere is pretty darned cheesed about it, because this can only lead to tyranny and the UN taking over and — worst of all — black people voting, many of them as often as once!!! According to The Hill:
Monitors will head to Arizona, California, Florida, Georgia, Illinois, Kansas, North Carolina, Nebraska, New Jersey, New Mexico, New York, Ohio, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas and Wisconsin.
“One of the Justice Department’s most sacred responsibilities is ensuring access to the ballot box for every eligible American,” Attorney General Eric Holder said in a video message on the department’s website.
“I want the American people to know that the Justice Department will stand vigilant — working in a fair and nonpartisan manner to ensure that every voter can cast his or her ballot free of intimidation, discrimination or obstruction,” he said.
This will be the first national election since the Supremes gutted the Voting Rights Act last year, and obviously, Eric Holder is trying to fuel a race war or something. Just look at the headlines!
From the “Powerline” blog (which surprisingly has nothing to do with the electrical grid): Eric Holder Deploys Poll-Watchers to Look for “Discrimination.” Blogger John Hinderaker asks why this is even necessary, since The Blacks have all the power in American elections anyway:
Have you ever seen anything at a polling place that remotely amounted to intimidation, discrimination or obstruction? I haven’t. Presumably this is all part of the Democrats’ effort to keep alive the myth of voter suppression. That pretense seems to be a key element in their strategy to keep African-American voters in the fold, notwithstanding that the Democrats’ policies are devastating to black voters’ interests. And I guess it must work.
But doesn’t reality intrude at some point? Didn’t blacks vote more heavily, pro rata, than whites in 2012? I believe they did. Does that mean that white voters are somehow being “suppressed”? And when blacks go to the polls in record numbers, as they have been, isn’t it blindingly obvious that no one is trying to intimidate, obstruct or discriminate against them?
And he’s right — blacks actually did have higher electoral participation in 2012, for the first time in history. Therefore, there are no efforts to change that, nope, none at all. Gosh, that Eric Holder sure is paranoid.
Rick “Get A Brain” Moran at “American Thinker” (proving that our truth-in-labeling laws are far too weak) headlines his piece — and we’re pretty sure he is being sarcastic — “The integrity of the ballot is in the very best of hands,” and also warns that George Soros is getting his shock troopers into the act as well:
Meanwhile, the George Soros-funded group Common Cause is also sending poll watchers across the country to insure that there’s plenty of work for Democratic lawyers who see GOP perfidy under every bed and behind every corner.
But don’t worry, armed citizens, Moran sees right through the lies, and knows what the DOJ’s real agenda is:
A “fair and nonpartisan manner”? If so, it would be a first. And who gets to define “intimidation”? Or “obstruction”? If a GOP poll watcher questions whether someone can legally cast a ballot, will that be considered “intimidation”? Of course it will be.
Those “poll watchers” are not there to ensure a fair vote. They are there to harass those who do. Guaranteeing that as many people cast their ballots as possible — regardless of whether they can legally vote — is the goal of both the DoJ and Common Cause.
At the bizarrely formatted TownHall.com, Wonkette frenemy Katie Pavlich is very, very upset that the DOJ will be looking to make sure that bilingual voting materials will be available, because obviously Holder wants illegal aliens to vote. She lazily copypastes a blockquote from the DOJ website, and just puts the scary part in boldface (we’ve used italics since WordPress doesn’t do bold in blockquotes, the bastards):
“Just as they do during every election, these officials will gather information on numerous aspects of local election procedures, including whether voters are treated differently depending on their race or color; whether jurisdictions are adequately serving individuals with disabilities; whether jurisdictions are complying with the provisional ballot requirements of the Help America Vote Act; and whether jurisdictions are complying with the Voting Rights Act’s requirement to provide bilingual election materials and assistance in areas of need,” a statement released on Justice.gov states.
To be all fair and crap, we double-checked — the emphasis is all Pavlich. Eric Holder, why are you helping foreigners to vote, huh?
And there’s plenty more: “Liberty News” asks whether Holder is “Hoping to Fix Elections?” and warns that Holder is working on Barack Obama’s direct orders, trying to find “something — anything — he can say is wrong in the elections in order to stop a GOP landslide.” Libery News also describes the Voting Rights Act as “the federal election law that forced southern states to go hat-in-hand to the feds to approve state election rules” and praised the Supreme court for “returning power to the states.” Not that the states ever abuse that power.
The Blaze ominously suggests that Big Brother is trying to scare away patriots: “As Americans head to the polls on Election Day, voters in 18 states will be casting their ballots under the watchful eye of the Department of Justice” and repeats a debunked claim that armies of non-citizens are voting all over the place.
Oh, and of the pieces we looked at, all but two mentioned the Great Election Fraud of 2008, when two New Black Panthers threw the national election to Barack Obama by standing in front of a single. polling place.
Yr Wonkette would just like to wish a happy Election Day to all of you, and to urge federal monitors to keep an eye out for overzealous patriots who may want to take their Second Amendment Voting Tool to the polls.

Report: Did Eric Holder Participate in ‘Armed’ Occupation of Columbia ROTC Office?

The Daily Caller is reporting that the nation’s highest-ranking law enforcement official, Attorney General Eric Holder, participated in what has been described by some as an “armed” takeover of Columbia University’s Naval Reserve Officer Training Corps (ROTC) office in 1970.
Apparently Holder was one of the leaders of the Student Afro-American Society (SAAS) that demanded the abandoned ROTC center be transformed into the “Malcom X Lounge.”
Holder described the five-day event during a 2010 commencement speech: “[Several] of us took one of our concerns — that black students needed a designated space to gather on campus — to the Dean [of Freshmen]’office. This being Columbia, we proceeded to occupy that office.”
Holder, however, recalls the event as being “peaceful.”
The Daily Caller continues:
The details of the student-led occupation, including the claim that the raiders were “armed,” come from a deleted Web page of the Black Students’ Organization (BSO) at Columbia, a successor group to the SAAS.  Contemporary newspaper accounts in The Columbia Daily Spectator, a student newspaper, did not mention weapons.

Though then-Dean Carl Hovde declared the occupation of the Naval ROTC office illegaland said it violated university policy, the college declined to prosecute any of the students involved.  This decision may have been made to avoid a repeat of violent Columbia campus confrontations between police and members of Students for a Democratic Society (SDS) in 1968.
The ROTC headquarters was ultimately renamed the Malcolm X lounge as the SAAS organization demanded.  It later became a hang-out spot for another future U.S. leader, Barack Obama, according to David Maraniss’ best-selling ”Barack Obama: The Story.” [Emphasis added]
In 1968– soon before Holder arrived on campus– the SAAS collaborated with the SDS to prevent a gymnasium from being built, and briefly held Dean Henry Coleman hostage.  As recently as 2010, according to the Daily Caller, the perpetrators were described as “armed with guns.”

Here’s the relevant section from the now-deleted article:
In 1970, a group of armed black students seized the abandoned ROTC office on the first floor of Hartley Hall. The students, joined by the then State Senator David Patterson renamed the space the Malcolm X lounge, in honor of a man who recognized the importance of territory as a basis for nationhood. Subsequently, murals were painted on the walls depicting black leaders such as Marcus Garvey and Sekou Toure.
But that’s not all.  The SAAS was also openly supportive of the Black Panthers, it seems, and Holder soon joined another group that bullied professors who failed to support affirmative action.
The Daily Caller continues:
In March 1970 the SAAS released a statement supporting twenty-one Black Panthers charged with plotting to blow up department stores, railroad tracks, a police station and the New York Botanical Gardens.

The April 21, 1970 SAAS raid on the Naval ROTC office and Dean Coleman’s office came one month after the Black Panther arrests.  The Columbia Daily Spectator released a series of demands from the student leaders on April 23 in which they claimed to be occupying the ROTC office for the purpose of “self-determination and dignity.”  They needed the space, they said, because of “the general racist nature of American society.”
Holder also joined the Black American Law Students Association in 1973, the Daily Caller relates, where he took part in pressuring six Columbia professors into retracting their letter to President Ford disagreeing with affirmative action.
“Merit should be rewarded, without regard to race, sex, creed, or any other external factor,” the professors wrote, but changed their stance due to what two professors described as the “rhetoric and names hurled” at them.
Eric Holder’s detractors note that much of the story is not unexpected for the current attorney general.  Still a staunch supporter of affirmative action, Holder has also come under heavy fire forfailing to take action against the New Black Panthers for alleged voter intimidation in 2008.

Reminder as Ferguson Tension Grows: Obama Marched With The Black Panthers

The tension over Ferguson continues to get worse around the country with President Obama, Attorney General Eric Holder and Al Sharpton leading the way. 
According to local media reports, members of the New Black Panther Party planned to blow up the St. Louis Gateway Arch and to assassinate Ferguson Police Chief Tom Jackson and prosecutor Bob McCulloch in response to the non-indictment of former police officer Darren Wilson by a grand jury.
St. Louis-area media outlets are reporting that two New Black Panther Party men were plotting to use the Ferguson chaos that was projected post-grand jury ruling as a shield to kill Police Chief Tom Jackson and prosecutor Bob McCulloch.
New Black Panther Party members Brandon Orlando Baldwin and Olajuwon Ali Davis were taken into custody on Nov. 20 for providing false information while buying guns at Cabela’s in a suburban area of Missouri, federal prosecutors said.
Federal prosecutors also said the two bought what they believed to be a pipe bomb from undercover officers and were going to blow up the iconic Gateway Arch, media previously reported.
The two have been charged so far with aiding and abetting the making of a false written statement in connection with a firearms purchase, the New York Daily News reported.
But now law enforcement say the men’s plot went much deeper — and that the two were actually going to use the violence that was projected to erupt in the streets on the heels of the grand jury ruling as a cover to kill two key Ferguson officials: Mr. McColloch and Mr. Jackson. 
Will these New Black Panther members be heavily prosecuted? Hardly. In typical fashion, Attorney General Eric Holder has their back and is giving them a pass with only minor gun charges. More from the Free Beacon:
The communist and racist New Black Panther Party plotted to bomb St. Louis’ Gateway Arch and assassinate local law enforcement officials, but the Justice Department so far has limited its prosecution of the group to an indictment of two members on minor gun charges.
The soft treatment for activities that normally would have brought federal terrorism charges appears to be part of efforts by Attorney General Eric Holder and the Justice Department to “go soft” on the racist group, according to former Justice official J. Christian Adams.
“I have always been perplexed why these guys get special treatment,” said Adams, who worked in the Justice Department Civil Rights Division and noted a similar conciliatory legal treatment of New Black Panther Party members in a 2008 case of voter suppression by the group in Philadelphia.
Justice Department spokesman Marc Raimondi declined to comment on the Black Panther bomb plot and would not say whether additional charges in the case are pending.
Back during the 2008 presidential election, New Black Panther Party members were caught on video intimidating voters outside of a Philadelphia polling place with nightsticks. Charges were completely dropped by DOJ in late summer 2009.
Because of the developments in Ferguson, now is a good time to remind everyone that as Senator Obama, the current President of the United States marched with the New Black Panther Party in the streets of Selma, Alabama. FromBreitbart:

The photographs, captured from a Flickr photo-sharing account before it was scrubbed, are the latest evidence of the mainstream media’s failure to examine Obama’s extremist ties and radical roots.
In his book Injustice: Exposing the Racial Agenda of the Obama Justice Department, DOJ whistleblower and civil rights attorney J. Christian Adams published more photos of Obama marching wit the Panthers, including the notorious Malik Shabazz.
Among those appearing with Obama was Shabazz, the Panther leader who was one of the defendants in the voter intimidation case that Attorney General Eric Holder dismissed. Also present was the Panthers’ “Minister of War,” Najee Muhammed, who had called for murdering Dekalb County, Georgia, police officers with AK-47’s and then mocking their widows.
Earlier this year, President Obama nominated cop-killer advocate Debo Adegbile to head up the Civil Rights Division at the Department of Justice. The copkiller Adegbile voluntarily advocated for during his time as the head of the NAACP legal defense fund is former Black Panther Party member Mumia abu-Jamal. In 1982, Abu-Jamal was unanimously convicted by black and white jurors for the murder Philadelphia Police Officer Daniel Faulkner. Abu-Jamal never denied the killing during his trial. He, and his supporters, are still unapologetic for Faulkner's killing. Under Adegbile's leadership Abu-Jamal's death sentence was overturned after arguments made in court that Officer Faulkner was and the justice system is, racially biased against black men.
"It is absolutely my honor to represent Mumia Abu-Jamal. It is my pleasure, it is my honor to have that opportunity and there is no question in my mind, there is no question in the mind of anyone at the Legal Defense Fund that the justice system has completely and utterly failed Mumia Abu-Jamal and in our view, that has everything to do with race and that is why the legal defense fund is in this case," attorney Christina Swarms said during the event. "We are acutely aware that the injustices of the criminal justice system are inextricably bound up in race." 
After the Supreme Court threw out the Beard v. Abu-Jamal case in 2010, a petition was circulated calling for President Obama and Attorney General Holder to investigate the “long history of civil rights and constitutional violations" in Abu-Jamal's case. Thankfully, Adegbile's nomination was blocked in the Senate.
This is who President Obama and Attorney General Eric Holder are. Members of the New Black Panther Party are people they not only relate to, but stand by at all costs. This is exactly why they've turned Ferguson into a race case with zero evidence to prove their claims. This is why Ferguson is so important to them and despite what the majority in the media would have Americans believe, these associations greatly matter and provide the context for the actions of Obama and Holder moving forward.

Eric Holder’s Radical Past Uncovered
• Affiliation with violent Black Panthers while in college may explain AG’s anti-white bias

Attorney General Eric Holder’s reluctance to prosecute criminal behavior on the part of the Black Panthers in Philadelphia during the 2008 presidential election apparently has its roots in his own affiliation with the group as far back as 1970. While a freshman at Columbia University that year, Holder participated in a five-day, armed protest and occupation of the university’s Naval Reserve Officer Training Corps (ROTC) building organized by the “Black Students’ Organization” (BSO).
It has not been ascertained whether the AG was ever a card-carrying member of the Black Panthers. However, he was an active member on campus of the Student Afro-American Society (SAAS) that released a statement supporting the efforts of 21 Black Panthers charged with plotting to blow up a police station, department stores, railroad tracks and the New York Botanical Gardens.





News stories from BSO’s defunct website show that it wasn’t the first time. Gloating over a 1968 confrontation with police the paper  reported:
“Armed with guns, the students took over Hamilton Hall, and locked the building from the inside. After some time the black students told the white sympathizers, many of whom were members of Students for a Democratic Society, to leave and contribute by taking over other buildings on campus. They did, effectively shutting down the university. The president of the university ordered the NYPD to smother the protest by force, aided by white athletes and members of the ROTC. Ironically it was the white students in other buildings who bore the brunt of the police storming. Had the police broken into Hamilton, they may have suffered casualties at the hands of the sisters and brothers inside.”
Two years later, Holder was among the leaders of the SAAS that were demanding the former ROTC office be renamed the “Malcolm X Lounge” in honor of the early Black Muslim leader who was assassinated in 1965.
Speaking to the 2009 graduating class at Columbia, America’s top lawman mistakenly remembered it as his “senior year,” and boasted of his participation in the movement during his college days. However, he deceitfully tempered his remarks by calling it a protest to “peacefully occupy one of the campus offices.”
The Justice Department has not responded to a query of what kind of weapon Holder himself was carrying at the time, but his friend, Steve Sims, told a mainstream newspaper it all did happen.
This may explain why Holder refused to prosecute Black Panther thugs, who were accused of intimidating voters with truncheons at the polls in Philadelphia in 2008.

If there's one person who's glad the Senate gridlock over Loretta Lynch's attorney general nomination is over, it's the man she's set to replace.
The Senate finally voted to confirm Loretta Lynch as attorney general yesterday, five months after President Obama named her his nominee. Eric Holder, the outgoing attorney general, had announced he would stay at the Justice Department until a successor was named when he resigned in September — but he probably didn't anticipate another half-year in Washington. As months passed and Holder's term dragged on, some of his staff started circulating black rubber wristbands with the message "Free Eric Holder" as a protest of Lynch's protracted nomination.
Now, seven months after announcing his resignation, Holder finally made his goodbye speech Friday. In it, he proclaimed: "I think we can officially say now that Eric Holder is free." He then reportedly took the "Free Eric Holder" wristbands off his wrist and threw them into the audience.

JOSEPH CONNOR: Eric Holder gave aid to terrorists

Only days before President Obama’s inauguration in Jan., 2009, I was invited to testify at Eric Holder’s confirmation hearing regarding his engineering, as deputy attorney general, the infamous 1999 Clinton clemency grants to 16 unrepentant members of the Puerto Rican terror group, Armed Forces of National Liberation (FALN).
From 1974 to 1983, the Marxist FALN waged a bloody war against the United States that included more than 130 bombings, leaving five murdered and scores wounded. On Jan. 24, 1975, the FALN’s most deadly attack, the infamous lunchtime bombing of Fraunces Tavern, a New York City landmark, killed my father, Frank Connor, 33, and three other innocent men. It was the day we were to celebrate my brother’s 11th birthday, and my ninth.
An FALN communique took credit for the attack, calling it a blow against “reactionary corporate executives.” In fact, my dad was born to immigrants and raised in working-class Washington Heights, not far from many of the FALN terrorists and just across the river from the Bronx where Eric Holderwas reared.
The FALN continued its reign of terror until the early 1980s, when 11 of its members were convicted of (among other serious felonies) weapons possession and seditious conspiracy. Their prison sentences ranged from 55 to 70 years. Our shattered family felt safer and that a semblance of justice for our father had been reached as these terrorists were essentially put away for life.
That is until 1999, when Eric Holder masterminded President Clinton’s clemency grants that were almost certainly intended to ingratiate carpetbagger and first lady Hillary Rodham Clinton with New York’s Hispanic community for her planned 2000 senate campaign.
These terrorists did not apply for clemency but had freedom thrust upon them by Mr. Holder and an administration that met with terror supporters a reported nine times, yet ignored victims and their families in violation of the Victims Rights and Restitutions Act.
Clemency was vehemently opposed by the FBI, police unions and the Bureau of Prisons, among others. The terrorists weren’t required to provide evidence for unsolved crimes as a condition for their freedom. The terrorists actually refused the nominal conditions of clemency and for 30 days were allowed to discuss the individual grants on conference calls between prisons. They ultimately left prison on Sept. 10, 1999.
Only days after his release, FALN member Ricardo Jimenez showed his astounding lack of contrition, telling Tim Russert on “Meet the Press” that my father died at Fraunces Tavern because “measures were not taken that were necessary by the people who owned those establishments.”
One of the FALN, Oscar Lopez Rivera was so unrepentant that he refused clemency and remains in prison today.
These are the people Mr. Holder and the Clintons unleashed on the American public.
Despite our warnings at congressional hearings about how releasing terrorists would only encourage more terrorism, two years later, our father’s godson, Steve Schlag, was murdered with 3,000 others in the north tower of the World Trade Center on Sept. 11, 2001. I witnessed the explosions from my nearby office, having just commuted through the WTC.
At Mr. Holder’s 2009 Senate confirmation hearing, I wrote, “Holder clearly does not have the judgment, character or values to be attorney general.” By releasing terrorists, Mr. Holder played Russian roulette with the American people he was sworn to protect. He should have been disqualified from being attorney general for this act alone.
Anyone paying attention then would have drawn the same conclusion. Unfortunately, 19 of the 39 Republican and all of the Democratic senators were either too blind to see or unwilling to listen. Mr. Holder was overwhelmingly confirmed as attorney general.
Equally unfortunate is that my predictions came true. As attorney general, Mr. Holder played Russian roulette again; this time by arming narco-terrorists during Fast and Furious. Brave U.S. Special Agents Jaime Zapata and Brian Terry, and countless Mexican civilians lost his deadly game, paying with their lives.
Mr. Holder’s abysmal record as attorney general can be traced to his days under Mr. Clinton. His role in releasing terrorists from Guantanamo Bay, his reckless approval of the trade of Sgt. Bowe Bergdahl for the Taliban Five, his treatment of terrorists as ordinary criminals, and his lack of a demand for the return of terrorist fugitives, including FALN bombmaker William Morales from Cuba during the normalization process were all predictable when viewed through the lens of the FALNclemencies.

At Supreme Court, Eric Holder’s Justice Dept. Routinely Backs Officers’ Use of Force

WASHINGTON — Teresa Sheehan was alone in her apartment at a mental health center, clutching what her lawyers said was a small bread knife and demanding to be left alone. San Francisco police officers, responding to a call from a social worker, forced open the door, blinded her with pepper spray and shot her.
It was the kind of violent police confrontation that Attorney General Eric H. Holder Jr. has frequently criticized in Cleveland; Albuquerque; Ferguson, Mo.; and beyond. But last month, when Ms. Sheehan’s civil rights lawsuit reached the Supreme Court, the Justice Department backed the police, saying that a lower court should have given more weight to the risks that the officers faced.
At the Supreme Court, where the limits of police power are established, Mr. Holder’s Justice Department has supported police officers every time an excessive-force case has made its way to arguments. Even as it has opened more than 20 civil rights investigations into local law enforcement practices, the Justice Department has staked out positions that make it harder for people to sue the police and that give officers more discretion about when to fire their guns.
Police groups see Mr. Holder as an ally in that regard, and that pattern has rankled civil rights lawyers, who say the government can have a far greater effect on policing by interpreting law at theSupreme Court than through investigations of individual departments.
“There is an inherent conflict between people at the Justice Department trying to stop police abuses and other people at the Justice Department convincing the Supreme Court that police abuses should be excused,” said Ronald L. Kuby, a Manhattan civil rights lawyer.
To some extent, conflict is built into the system. The Justice Department’s core mission is law enforcement. It oversees the Federal Bureau of Investigation, the Drug Enforcement Administration and the Bureau of Alcohol, Tobacco, Firearms and Explosives, among others. In every administration, it is in the government’s interest for federal agents to have as much leeway, and as little liability, as possible.
“It’s natural that the instinctive reaction of the department is to support law enforcement interests, even when a particular case may have compelling facts for the individual defendant,” said Neal K. Katyal, a former acting solicitor general in the Obama administration. He said the Justice Department had a duty to tell the court what effect a ruling could have for federal law enforcement agencies.
When police abuse cases make it to the Supreme Court, even if they have nothing to do with federal agents, the Justice Department often weighs in. Last year, the department sided with police officers in West Memphis, Ark., who shot a driver and passenger 15 times, killing them at the end of a chase.
John F. Bash, a Justice Department lawyer in that case, told the justices that “there is some level of reckless driving in response to a police pursuit that authorizes the use of deadly force.” What was certain, he added, was that the officers were entitled to qualified immunity, which shields them from civil rights lawsuits. The Supreme Court unanimously agreed.
Every such victory makes it harder for citizens to prevail when they believe they have been mistreated by police officers. It also adds obstacles for the Justice Department’s own civil rights investigators when alleging police misconduct. That has led to some tense debates inside the department, current and former officials say, as the government’s civil rights and appellate lawyers discussed when the department should weigh in, and on which side. Those debates have led the Justice Department to take more nuanced positions than government lawyers might have otherwise, the officials said.
“Law enforcement officers are routinely called upon to face grave dangers and to make often-unheralded sacrifices, and the law must give them the room to make real-time judgments to protect public safety,” said Emily Pierce, a Justice Department spokeswoman. “At the same time, building trust between law enforcement and the communities they serve and protecting human life and human dignity requires accountability for law enforcement officers. The department recognizes — and is committed to striking — that balance.”
Mr. Holder has called the civil rights division the crown jewel of the department, and it has rarely had such a high profile. Even before it garnered national attention with a scathing rebuke of the Ferguson Police Department after the fatal shooting of an unarmed black teenager by a white officer last summer, the division issued similar reports on other departments, including those in Seattle, Albuquerque, Newark and New Orleans.
Those efforts, along with deeply personal remarks from Mr. Holder about racial profiling, have drawn criticism from police officers who say he has not supported them. But Darrel W. Stephens, the executive director of the Major Cities Chiefs Association, said many officers probably did not know how often Mr. Holder’s Justice Department stood with them at the Supreme Court. “He’s sincere,” Mr. Stephens said. “He is supportive of the police.”
Private civil rights lawyers, though, have been frustrated that the Justice Department’s aggressive stance in civil rights reports does not extend to its positions before the Supreme Court. “A report can have an impact on a department for a time,” said Gary Smith, the lawyer for the driver in the Arkansas case. “But case law touches every officer in every department in the country.”
Eventually, he predicted, police departments facing civil rights investigations will challenge the Justice Department on its apparently contradictory positions. “You’re telling the Supreme Court it’s O.K., and you’re doing this to us?” Mr. Smith said.
When Justice Department lawyers argue before the Supreme Court, they typically draw fine distinctions and avoid outright contradictions. But such cases can send seemingly mixed messages. For example, the civil rights division said in December that police officers in Cleveland were too quick to use force against mentally ill people. For support, it cited the federal appeals court decision in the case of the mentally ill woman in San Francisco — the same decision that Justice Department lawyers would argue against a few months later.
Similarly, the Justice Department criticized the Sheriff’s Office in Franklin County, Ohio, in 2010 for using stun guns on inmates while they were handcuffed and posed no threat, or when they committed minor rule violations. In a Supreme Court case to be heard this month, the Justice Department has sided with Wisconsin jail officials who used a stun gun on an inmate after he was handcuffed and taken from his cell for refusing to remove a piece of paper covering a light fixture in his cell.
The Justice Department sees those cases as evidence not of conflict but of how its lawyers strike a balance. In the Sheehan case from San Francisco, despite siding with the police, they argued that officers must make some accommodation for a person’s mental illness when making an arrest. And in the Wisconsin case, they agreed with the inmate about the legal standard needed to prove abuse, even as they again supported the police.
For Mr. Holder, altering the approach to police abuse cases would amount to a major policy change, one that F.B.I. agents and other federal investigators would surely oppose, said William R. Yeomans, an American University law professor who served in senior roles in the civil rights division during the Clinton administration. So when tensions arise, protecting federal agents almost always wins. “Obviously it’s a problem,” he said. “The institutional interests in support of law enforcement are very powerful and very real.”
Because of that history, Steven R. Shapiro, the legal director for the American Civil Liberties Union, said it was unfair to criticize Mr. Holder’s tenure too harshly. The Justice Department has always advocated its law enforcement authority, he said. And the A.C.L.U. often opposes those efforts. But he said no administration had done more to curb police abuses or to force a national debate over the issue.
“Civil rights has a voice at the table more often and more prominently under this administration than in previous administrations. It’s not merely symbolic,” he said. “To the extent there is dissonance, we’re noticing the dissonance because the civil rights voice is more prominent than in the past.”

Flashback: 5 Memorable Clashes Eric Holder Had With Congress | Video

Friday marks the final day of Eric Holder’s controversial tenure as attorney general. Most of that controversy spilled over to Capitol Hill, whether in the course of long-running investigations or in getting into spats with members during congressional hearings.

1. Operation Fast and Furious
The Justice Department’s botched Operation Fast and Furious led to more than 100 Republican members of Congress calling for Holder to resign and eventually led to a bipartisan vote to hold the attorney general in contempt of Congress.
The flawed operation allowed some 2,000 guns to flow into Mexican drug-trafficking organizations, two of which were found at the murder scene of U.S. Border Patrol agent Brian Terry. Investigators suspect the guns might have been used in other crimes inside Mexico.
When Holder failed to produce thousands of documents requested by the House Oversight and Government Reform Committee, the committee and later the full House of Representatives voted to hold him in contempt of Congress, with 17 Democrats voting for the contempt charges and two Republicans voting against.
As more documents trickled out last year, one of the emails showed Holder had slammed then-Oversight Chairman Darrell Issa (R-Calif.) and his “idiot cronies.”
2. Misleading on Leak Probes
A 70-page reported by the House Judiciary Committee in July 2013 determined Holder gave “deceptive and misleading” testimony in May telling Congress he wasn’t involved in and wasn’t aware of potential prosecution of journalists in leak investigations.
“With regard to potential prosecution of the press for the disclosure of material, that is not something that I have ever been involved, heard of, or would think would be a wise policy,” Holder said in his May testimony.
The House report concluded: “We believe that Mr. Holder’s simple and direct statement had the intended effect — to leave the members of the committee with the impression that not only had the potential prosecution of a reporter never been contemplated during Mr. Holder’s tenure, but that nothing comparable to the Rosen search warrant had ever been executed by this administration. On the basis of Mr. Holder’s testimony, there was little doubt in the members’ minds that the legal machinery for such an undertaking had never been started.”
3. Reluctance on ‘Radical Islam’
In May 2010, then-ranking member of the House Judiciary Committee Lamar Smith (R-Texas) asked Holder during a hearing if radical Islam is a contributing factor to recent terrorism cases.
“There are a variety of reasons why I think people have taken these actions,” Holder replied. “One, I think just look at each individual case. We are in the process how of talking to Mr. Shahzad to try to understand what it is that drove him to take the action.”
Faisal Shahzad, a Pakistani-American citizen, was convicted for attempting to set off a car bomb in Times Square in May 2010.
Smith followed, “But radical Islam could have been one of the reasons?”
Holder again said, “There are a variety of reasons.”
Smith later asked, “But all I’m asking is do you think among those variety of reasons, radical Islam might have been one of the reasons that the individuals took the steps that they did?”
After a two-minute exchange, Holder finally said, “I certainly think that it’s possible that people who espouse a radical version of Islam have had an ability to have an impact on people like Mr. Shahzad.”
4. Shaky with Ted Cruz on Domestic Drone Strikes
During a March 2013 hearing of the Senate Judiciary Committee, Sen. Ted Cruz (R-Texas) pressed Holder on a letter the attorney general sent to Sen. Rand Paul (R-Ky.), that was less than clear about whether the administration would consider a domestic drone strike against a U.S. citizen constitutional.
“I would not think that that would be an appropriate use of any kind of lethal force. We would deal with that in a way we would typically deal with a situation like that –” Holder began to respond, before Cruz interrupted.
“With all due respect … my question wasn’t about ‘appropriateness’ or prosecutorial discretion, it was a simple legal question,” Cruz followed. “Does the Constitution allow a U.S. citizen on U.S. soil, who doesn’t pose an imminent threat, to be killed by the U.S. government?”
“I do not believe that — again, you have to look at all of the facts,” Holder said. “On the facts you have given me, this is a hypothetical, I would not think that in that situation the use of a drone or lethal force would be appropriate because —.”
Cruz went on to state, “I think it is unequivocal that if the U.S. government were to use a drone to take the life of a U.S. citizen on U.S. soil and that individual didn’t pose an imminent threat, that that would be a deprivation of life without due process.”
5. Dissing Louie Gohmert Over ‘Asparagus’ Gaffe
After the Boston bombings in 2013, Rep. Louie Gohmert (R-Texas) got into an exchange with Holder and ended up declaring, “The attorney general will not cast aspersions on my asparagus!”
It was a moment that gained some attention from liberal websites and one that Holder did not forget when the two had another exchange in April 2014.
“I realize that contempt is not a big deal to our attorney general, but it is important that we have proper oversight,” Gohmert said.
Holder responded, “You don’t want to go there, OK?”
After a few more words, Holder snapped, “Good luck with your asparagus.”

The Justice Department on Friday posted a massive 28,000-word list of accomplishments that Attorney General Eric Holder achieved over the last six years, as part of a tribute to Holder on his last day in office.
When dumped into a word processor, it fills 46 pages — about the size of a small novella.

Attorney General Eric Holder was sent off on his last day of work with a huge list of accomplishments that he achieved while in office, one that fills 46 pages. (AP)
The list goes into Holder’s efforts to protect America from terrorism, thwart drug smuggling, stop violent crimes and cybersecurity threats, and help prisoners re-enter society.
The list doesn’t list some of the more controversial aspects of Holder’s tenure, such as his department’s decision to seize phone records from reporters, or the botched gun-running operation known as Fast and Furious that some say contributed to the shooting death of U.S. Border Patrol agent Brian Terry.
It also doesn’t note that in 2012, Holder was held in contempt of Congress for the department’s failure to provide information about Fast and Furious to Congress.
The Justice Department also produced a nine-minute video to send Holder off, one filled with praise from Democrats such as former President Bill Clinton, Chicago Mayor Rahm Emanuel, and several Democratic senators.
Holder was expected to speak at 2 p.m. Friday in a farewell ceremony. His replacement, Loretta Lynch, was confirmed by the Senate on Thursday.

As Attorney General Eric Holder finally departs, he leaves behind a demoralized Justice Departmentthat has been politicized to an unprecedented degree.
Attorneys general are obligated to enforce the law in an objective, unbiased and nonpolitical manner. They must demonstrate the highest regard for the best interests of the public and their sworn duty to uphold the Constitution and the laws of the United States. Prior attorneys general of both political parties, such as Benjamin Civiletti, Griffin Bell, Ed Meese and Michael Mukasey, have fulfilled that duty to the highest ethical and professional standards.
But not Eric Holder. He put the interests of his political boss first, and the interests of the administration of justice a very distant second. When President Obama bent, broke, changed or rewrote the law, the person at his side advising him how to do it was Eric Holder. All the while, he maintained a facade of respect for the rule of law, something for which he and the president have, at times, shown utter contempt.
Mr. Holder’s failure to enforce federal laws such as our immigration statutes on a wholesale basis is a particularly acute betrayal of the most basic standard that applies to the attorney general. Instead of acting as the nation’s chief law enforcement officer, Mr. Holder instead has acted as the political lawyer of an overly partisan president. Perhaps that’s why Mr. Holder has one of the lowest approval ratings of any public official.
The recent cases in which judges have found Justice Department prosecutors to have engaged in prosecutorial abuse during Mr. Holder’s tenure show how much this high-level corruption has also seeped into the lower levels of the department.
In a failed prosecution of a peaceful abortion protester, for example, a federal judge remarked on the nearly total lack of evidence of any violation of the law. The protester had been targeted to chill the political speech of pro-life advocates. In another case involving police officers in New Orleans, a federal judge found the Justice Department had committed “grotesque prosecutorial abuse” and complained about the “skullduggery” and “perfidy” of Justice prosecutors.
The politically motivated hiring in the civil service ranks that has gone on in parts of the Justice Department, such as the Civil Rights Division, guarantees that radical ideologues will continue to permeate the department for years to come. As former federal prosecutor Andrew McCarthy has said, under Eric Holder the Justice Department has become a “full employment program for progressive activists, race-obsessed bean counters (redundant, I know), and lawyers who volunteered their services during the Bush years to help al Qaeda operatives file lawsuits against the United States.”
The legal theories advanced by the administration have been so far outside of the mainstream that the U.S. Supreme Court has ruled against Mr. Holder’s Justice Department unanimously almost two-dozen times. Those cases have ranged from the Hosanna-Tabor decision, where the Justice Department claimed the religious freedom clause of the First Amendment did not protect the hiring decisions of a church, to the Sackett case, where the Justice Department tried to prevent a family from defending itself in court and contesting a ludicrous administrative order from Environmental Protection Agency bureaucrats that would subject them to a fine of up to $75,000 a day.
Many of those cases have a common theme: a frightening view of unlimited federal power, one untempered by the Constitution and the Bill of Rights.
Eric Holder has aggressively used the enormous power of the Justice Department to abuse the liberty and economic rights of Americans, to manipulate racial politics and drive a wedge of hostility deep into our society, and to exploit the administration of justice as a political tool to benefit his president and his political party.
There is no way to know how long it will take to repair the damage he has done. One thing we do know — it will take a new attorney general with the political willpower and steadfastness of a kind that is rarely seen in Washington.
Unfortunately, it is unlikely Loretta Lynch will clean up Mr. Holder’s misbegotten legacy. She made it clear in her confirmation hearings that she did not disagree with a single act of Mr. Holder or Mr. Obama. Accordingly, her tenure will probably just be Holder 2.0.
To paraphrase Mark Twain, we won’t be invited to attend Eric Holder’s going-away festivities at theJustice Department, but we certainly approve of those festivities, since they mean that one of the worst attorneys general in recent memory is finally leaving the department.
