The hack on the U.S. government was not a ‘cyber Pearl Harbor’ (but it was a very big deal)

The U.S. government has suffered a hacking attack that has potentially revealed highly sensitive information about millions of government employees. Some commentators are claiming that this is the “cyber Pearl Harbor” that they have been warning of for years.
Noah Rothman, writing for Commentary, says that this attack aims at the “preventative neutering of America’s defensive capabilities” and compares to the moment when “the zeros [sic] screamed out of the sky over Hawaii in 1941.” Rothman also says that the “professorial voices of mock prudence” have been proved to be utterly wrong, referring to a Monkey Cage post. We don’t particularly object to being described as professorial voices of mock prudence, but the underlying errors in Rothman’s post provide a useful opportunity to clear up some of the widespread confusion about cybersecurity and cyber war.
The hack on the U.S. government was not the “cyber Pearl Harbor”
Very serious people, including then-Defense Secretary Leon Panetta, have warned that the United States is vulnerable to a “cyber Pearl Harbor.” They have cautioned that adversaries could launch attacks on “critical infrastructure” and seek to disable or degrade “critical military systems and communication networks.” They argue that this could have crippling consequences for the nation.
By referring to “cyber Pearl Harbor,” observers are talking about attacks that — like physical attacks — could disable communications systems, power plants, electricity transmission systems and the like. Such attacks would indeed resemble the one on the real Pearl Harbor, a devastating surprise attack that could determine the outcome of a war. Our original post talked about the risk of a “major online attack aimed at taking down key communications systems,” as did the research by Erik Gartzke that was summarized in the article.
But hacking into information on U.S. government employees, however sensitive, is not a Pearl Harbor attack. It doesn’t disable large-scale communications systems, power systems or the like. It doesn’t have any direct consequences for the nation’s ability to defend itself. Instead, it is an (extremely worrying) exercise in espionage, of the kind that the original post distinguishes from Pearl Harbor-type attacks, noting that even if Pearl Harbor-type attacks are unlikely, “many actors have an interest in penetrating U.S. networks to spy or to carry out covert actions.”
The distinction between warfare and spying is important
Since people have begun to worry about cyber warfare, military and civilian experts have stressed that there is a crucial difference between cyber warfare and cyber spying. As the National Academies of Science pointed out in one of the most influential early documents on cybersecurity, we shouldn’t treat spying as an exercise in the use of military force:
. . . if a cyberattack would have the same effects as certain governmentally initiated coercive/harmful actions that are traditionally and generally not treated as the “use of force” (e.g., economic sanctions, espionage, or certain covert actions), such a cyberattack should also not be regarded as a use of force.
This expert report further warns that treating cyber-espionage as the equivalent of a military attack “overstates the actual threat, thus inflaming public passion and beating the drums of war unnecessarily,” as well as incorrectly implying that the United States should respond militarily. In actuality, nations have been spying on one another for centuries without going to war over it.
A strong distinction between warfare and spying is in the nation’s interest
The National Academies report says that treating cyber-espionage as an act of war could mean that the United States found itself “outside international norms even when it might not object to limiting certain attack capabilities.” More plainly put, the nation doesn’t want to treat cyber-espionage as Pearl Harbor-type attacks, because it engages in an awful lot of cyber-espionage itself. If successful cyber-espionage is an act of war, then the United States is engaging in overt warfare all the time, against its allies as well as its adversaries.
Many reports suggest that China is responsible for this latest hacking incident. The United States has indeed been trying to force China to stop engaging in certain kinds of hacking. However, the United States has been arguing that political espionage (where governments try to discover information that is in their national interest) is okay, but that commercial espionage (where governments try to hack into companies to pass on trade secrets to their competitors) is not. As Jack Goldsmith notes, the recent hacking is just the kind of cyber-espionage that the U.S. government has been defending as acceptable. Moreover:
This is almost certainly the type of collection we are trying to do, and probably succeeding in doing, against China’s government officials. . . . We can hardly go ballistic if we are doing the same thing.
If the United States wanted to treat this as the equivalent of a Pearl Harbor attack by China, it would have to deal with the fact that it has been engaged in the same kind of hostilities against China. In fact, the U.S. government doesn’t want to treat this attack as the equivalent of an act of armed hostility, and it is perfectly right not to, regardless of how much excitable Internet commentators may want to condemn it.
The key implications are domestic
Even if the United States should not treat this as a “cyber Pearl Harbor,” it should treat it as an important wake-up call. Espionage is a very real problem, and it appears that the nation has seriously let down its defenses. At the very best, this is enormously embarrassing for the U.S. government. Very likely, it is seriously damaging, just as other major incidents of espionage have been in the past.
It’s clear that there are grave cybersecurity problems within the federal government. As Marcy Wheeler notes, elementary security steps were not taken. It is very likely that there are much worse problems in the private sector. The appropriate responses to these problems are painstaking and technical improvements in security and procedures, not amateur dramatics on the Internet.
As noted on the Monkey Cage, the new U.S. cyber strategy moves away from Pearl Harbor alarmism to a focus on “advanced persistent threats” — sneaky and continuous forms of hacking that can gather large amounts of data and subvert systems over time.

Considering the pace that hack attacks have taken place in the last few months, not only hascybersecurity become an important issue for the general public, but for the administration as well.
Retired U.S. Army General and former CIA Director David Petraeus was on this week's edition of Wall Street Week, where he discussed how devastating cyber attacks are for the U.S. and how dangerous this problem can become in the future.

Big, Big Challenge For U.S.

Petraeus thinks that hack attacks are "an enormous threat." He was asked whether it is a bigger threat than terrorism, to which he replied, "It depends on the day. In recent weeks and months, it arguably has been. When you look at the massive theft of personal data, the massive theft of intellectual property, the damage done to just to normal business by denial service attacks – look at the sheer cost of all of this to businesses in this city in particular.
" And I know there are banks that spend $500 million a year on cybersecurity now. Now, these are massive banks and they can afford it, but this is a big, big, big, big challenge for our country."

Petraeus was also asked about where he thinks these threats originate from. He replied, "Well, it originates in a number of different places. There is no question that the biggest, the industrial strength threat, emanates from China."

Could Be Worse In The Future

On whether cyber threat would be a worse problem five years from now, Petraeus said, "I fear that it will be, because again, there are lots of others out there. The Syrian Electronic Army has done a lot of damage around the world. There are groups in Russia; certainly there are other groups in the Mid-East. And you find a situation where extremists, you know it doesn’t take much in this world if you have some very, very capable, nefariously brilliant people."

Hotel costs for First Lady Michelle Obama to see cultural sites in Venice during the last leg of her trip overseas is costing taxpayers $128,781.
The First Lady left for London and Italy on Monday for her “Let Girls Learn” initiative and anti-obesity campaign Let’s Move. During the trip she will cook with children, visit U.S. service members stationed in Italy, and visit Prince Harry.
“From London, the First Lady will travel to Milan,” according to the White House press office. “As part of her Let’s Move! initiative, the First Lady will lead a Presidential Delegation to the Milan Expo 2015, representing our steadfast commitment to a healthier nation.”
The delegation is entitled “American Food 2.0: United to Feed the Planet.”
“Mrs. Obama and the Delegation will also participate in a cooking activity with children,” the press office said. “In addition to visiting the U.S. Pavilion, the First Lady will meet with Prime Minister Renzi, and tour the Italian Pavilion with Ms. Landini, the Prime Minister’s wife.”
“From there, the First Lady will travel to Vicenza, Italy,” they said. “As part of the Joining Forces initiative, Mrs. Obama will visit members of the military and their families stationed at U.S. Army Garrison Vicenza.”
“The First Lady looks forward to personally thanking the service members and their families and reminding them that their sacrifices have not gone unnoticed by the American people,” the press office said.
“The First Lady will also visit cultural sites in Venice before returning to Washington, D.C.,” the statement concluded.
A State Department contract for “Lodging for FLOTUS Venice,” shows costs of $128,781. The American Embassy in Rome awarded the contract, which was signed June 10.

Bureau of Prisons Puts CIA Whistleblower Jeffrey Sterling in Prison Around 900 Miles from Wife & Family

CIA whistleblower Jeffrey Sterling was notified at the end of last week that he will serve his prison sentence of three and a half years at Federal Correctional Institution Englewood, a medium-security facility in Littleton, Colorado, that is around 900 miles away from where his wife and family live in St. Louis. That is at least a 12-hour drive.
Sterling was convicted of committing Espionage Act violations and other offenses after the government convinced a jury, through largely circumstantial evidence, that he had leaked information on a top secret CIA operation to New York Times reporter James Risen. He begins his sentence on June 16.
“I am certainly devastated beyond belief that I won’t be near my wife and family,” Sterling stated. “My wife, family, and friends have been an important support system for me and being so far away is like a wedge being driven between me and those who continue to love, support, and believe in me.”
“The government likes to isolate whistleblowers from their natural allies, and now the Bureau of Prisons is trying to isolate them from their families,” declared Jesselyn Radack, the director of the Government Accountability Project’s National Security and Human Rights Division. “Once again, the Bureau of Prisons proves that ‘rehabilitation’ is not their priority or else they’d place prisoners near their families.”
Sterling and his wife, Holly, are already economically devastated from the prosecution. Now, Holly will have to spend hundreds of dollars on air travel each time she wants to see him, a factor that may greatly limit how frequently she visits her husband in prison.
The Bureau of Prisons (BOP) has a very weak policy when it comes to keeping inmates close to their “release residence” or homes. It “attempts to designate inmates to facilities commensurate with their security and program needs within a 500-mile radius of their release residence.”
“If an inmate is placed at an institution that is more than 500 miles from his/her release residence, generally, it is due to specific security, programming, or population concerns.” However, there are next to no mechanisms for an inmate to hold BOP accountable for improperly designating or placing them in an inappropriate facility.
There are no low security facilities close to St. Louis, but there are four low security facilities, which are closer to St. Louis than FCI Englewood:
FCI Forrest City – Forrest City, Arkansas – 4 hr 32 min – 313 miles
FCI Ashland – Ashland, Kentucky – 6 hr 35 min – 453 miles
FCI Waseca – Waseca, Minnesota – 7 hr 36 min – 500 miles
FCI Sandstone – Sandstone, Minnesota – 9 hr 34 min – 618 miles
Any of those facilities are closer to his family than FCI Englewood, and three of them arguably would fall within BOP’s 500-mile policy.
How does Sterling’s incarceration compare to previous cases of people prosecuted for leaks?
Stephen Kim, a former State Department employee who pled guilty to violating the Espionage Act, was incarcerated at a minimum-security camp in Cumberland, Maryland. Unlike the adjacent medium security facility, the camp has no concertina wire surrounding it. He was released from prison on May 12 after serving a 10-month sentence.
CIA whistleblower John Kiriakou was prosecuted for allegedly violating the Espionage Act. He pled guilty to violating the Intelligence Identities Protection Act (IIPA) and was sentenced to 30 months in prison. He served his sentence at a low security facility in Loretto, Pennsylvania, which was about 3 hours from his home.
During Kiriakou’s formal sentencing, the judge, prosecutors and Kiriakou’s attorneys agreed that he should be placed in Loretto’s minimum security camp. However, when he was processed, a corrections officer notified Kiriakou that BOP had deemed him a “threat to the public safety” and so his entire sentence would be served in the low security facility, not the camp.
Kiriakou discovered he was assigned a “public safety factor” designation when he was sentenced. According to the Bureau of Prisons, “There are certain demonstrated behaviors, which require increased security measures to ensure the protection of society. There are nine Public Safety Factors (PSFs) which are applied to inmates who are not appropriate for placement at an institution which would permit inmate access to the community [and allow them to be placed in a minimum security camp].”
The warden informed Kiriakou, “Prior to an inmate’s placement in the correctional facility, the DSCC conducts a thorough review of their record. The “Greatest Severity” Public Safety Factor was placed on inmate Kiriakou by the [Designation and Sentence Computation Center]. According to Program Statement 5100.08, Security Designation and Custody Classification Manual, crimes involving espionage, treason, sabotage or other related offenses fall within the greatest severity scale.” [*Here is a 2013 version of this manual: PDF.]
Kiriakaou used the “administrative remedy” process to challenge his designation but was unable to convince BOP that the agency was wrong.
“My crime should not fall under ‘Greatest Severity’ because it is not in any way related to ‘espionage, treason, sabotage or other related offenses.’ Although I was charged with espionage, all of those charges were dropped for the simple reason that I had not committed espionage,” Kiriakou wrote in multiple complaints to officials in FCI Loretto’s chain of command. (Note: IIPA is not even in the same part of the US code as espionage offenses.)
More than likely, Sterling has been given a similar “public safety factor” designation, even though he did not commit treason or spy on behalf of a foreign power. This prevents him from being placed in a minimum security camp like Kim.
Why was Kim incarcerated in a minimum security camp when he violated the Espionage Act and, by the BOP’s standards, committed an “espionage-related” offense that could have prohibited him from placement in a minimum security camp?
A key difference between Kim’s case and the cases of Kiriakou and Sterling is the fact that Kiriakou and Sterling both turned to the public to build support for them during their prosecution.
Kiriakou learned through a Freedom of Information Act request that he had been placed under Central Inmate Monitoring after he sent his first “Letter from Loretto.”
Central Inmate Monitoring by BOP is for prisoners who “present special needs for management.” A copy of the 2007 policy indicates inmates are given this designation “so that critical decisions about their cases are carefully reviewed.” It is supposed to make the “institution environment” more “safe” by “case management decisions based on accurate information and sound correctional judgment.” Yet, BOP applied this designation because of Kiriakou’s ability to have letters published by Firedoglake and because the letters would likely garner widespread media coverage.
One of the documents he obtained cautioned, ‘PUBLICITY—Inmate has broad access to the press. Attached are articles in which inmate has been mentioned.’” BOP wanted to monitor Kiriakou’s speech so they could control him.
Potentially, BOP has learned a few lessons after incarcerating Kiriakou. The BOP is putting Sterling in a facility in Colorado because the fact that he is so far away from family will help the prison control him. It may further discourage Sterling from speaking out while he is in prison through letters or interviews with reporters, even though BOP does not generally prohibit inmates from communicating with press.
Kiriakou had support when he was in prison and conducted interviews with media, but he did not have a group like Roots Action prior to his incarceration, which could quickly galvanize support through its network of activists.
Any retaliation experienced will be difficult for Sterling to challenge. The “administrative remedy” process is a toothless mechanism for inmates. There really is no accountability for BOP officials who inappropriately designate inmates for prisons far away from their families.
Sterling left the CIA in 2002 and brought a claim against the agency alleging racial discrimination. He appealed his case all the way to the Supreme Court in 2005. However, the government successfully had the case thrown out by invoking the “state secrets” privilege.
If Sterling is not a whistleblower because he revealed information to Risen, then he is a whistleblower because he stood up to the CIA over workplace discrimination and was effectively silenced.
Radack contended this is “further whistleblower retaliation” after Sterling’s conviction. “The government’s wrath knows no bounds,” Radack declared.
She added, “Given that the judge agreed with the defense’s request that Jeffrey be housed in Missouri near his wife and family, I’d be interested to find out how many conversations the Bureau of Prisons had with the Department of Justice.”
The Bureau of Prisons was contacted for comment but did not respond to an email to Public Affairs requesting clarification on the general policy for placing individuals in prisons more than 500 miles away from their families.

Iran Steps Up Cyber Attacks Across the Globe

Iran has significantly stepped up efforts to launch cyber attacks and hack into the critical systems of multiple Middle East governments, including those of Israel, Saudi Arabia, Yemen, and a host of other nations, according to a new report by a leading Israeli cyber security firm.
Iran’s cyber operations have become increasingly sophisticated over the past year, with the Islamic Republic aiming to obtain state secrets and penetrate sensitive online systems of various governments, according to a new report by ClearSky Cyber Security.
Iran has been suspected for some time of sponsoring cyber espionage attacks, with the majority being launched against Saudi Arabia and Israel.
Senior U.S. officials hinted at Iran’s growing spying operations in February, when they confirmed that Iran was behind a major hack attack on casino magnate Sheldon Adelson’s Sands Corporation.
After tracing Iran’s efforts for about a year, ClearSky discovered evidence that the Islamic Republic has targeted some 550 targets across the region and elsewhere in the world.
“We have learned of 550 targets, most of them in the Middle East, from various fields: research about diplomacy, Middle East and Iran, international relations, and other fields; Defense and security; Journalism and human rights; and more,” the report states.
These efforts include attempting to gain entrance to computer systems and email accounts associated with various targets.
“The campaign includes several different attacks with the aim of taking over the target’s computer or gain access to their email account,” according to the report. “We estimate that this access is used for espionage or other nation-state interests, and not for monetary gain or hacktivism.”
“In some cases, the victim is not the final target; the attackers use the infected computer, email, or stolen credentials as a platform to further attack their intended target,” it states.
Iran is primarily focused on Israel and Saudi Arabia, but also has targeted at least 16 other countries, according to a breakdown of the attacks.

These Iranian hackers have been “very successful in their attacks,” but due to a lack of sophistication have left traces of their presence that ClearSky was able to track.
“Various characteristics of the attacks and their targets bring us to the conclusion that the threat actors are Iranian,” the firm concludes. “In addition, we note that these attacks share characteristics with previously documented activities.”
These include attacks using malware, which infect a target’s computer system.
The Islamic Republic has used a series of well-known tactics to break into computer systems of governments and researchers, including Israeli ones.
The tactics include a method known as “spear phishing,” in which the attacker pretends to be an associate and weaponizes an email with malicious files.
The attackers have also impersonated individuals on the phone in order “to build rapport for one of the phishing emails,” according to the report.
They also have used Facebook messages in order to obtain personal information.
The report includes pictures of various emails believed to be sent by Iranian hackers.
“Several characteristics of the attacks have led us to the conclusion that an Iranian threat actor is the likely culprit,” ClearSky concludes.
“The context of the attacks and cover stories all revolve around Iran. Importantly, as determined by several professionals—the attackers speak and write in native Iranian Persian and make mistakes characteristic of Persian speakers,” states. “In one of the hacked accounts, when retrieved, the interface language had been changed to Persian.”
According to the report, “the targets and victims match the interests of Iran.”
Internet addresses and other information associated with the hack attacks also link back to Iranian actors, the report claims.

Former CIA analyst Timothy Walton begins his book with a discussion of the basic elements and tools of intelligence analysis, which in the end supports decision making. For example, after identifying various factors an analyst must be careful to consider—uncertainty, deception, surprise, estimates of the accuracy of judgments—he describes some of the important techniques that can be applied. These include the time-line or chronology, competitive hypotheses, and various matrix models. Finally; he stresses the value of presenting the decision maker with options when no single result is directly on point.
To illustrate how analysis has functioned in the past, he provides 40 historical “lessons” from biblical times to the present. While the reader might legitimately expect the lessons to demonstrate the techniques Walton presented in the introductory chapters, that is not what the lessons do. Instead, they are historical summaries that set the stage for analyses. For example, his account of Moses sending spies into Canaan only summarizes the conflicting reports he received and the resultant disagreement among the leaders. There is nothing about fact checking or other analyses that might have led to conclusions they might have reached. Likewise, in his discussion of Hitler’s surprise attack on the Soviet Union, Walton mentions Stalin’s requirements for intelligence and the indicators that an attack was imminent, but he does not analyze why Stalin steadfastly refused to believe them. In the case of the run-up to the attack on Pearl Harbor, Walton provides a good summary of what happened and then acknowledges it as “the most famous and consequential example of failure in intelligence analysis.” (p. 95) But he fails to describe the analyses performed by those involved that allowed for the surprise.
A similar approach applies in the case of the atomic bomb spies. He tells how the FBI learned of the espionage through defectors and the VENONA messages; but he neglects to comment on how the Bureau approached the difficult analytical problems the decrypts posed. The case also points to a major weakness of the book. None of the facts presented are sourced, and this leads to careless errors. Thus Walton writes: “shortly before Gouzenko’s defection [5 September 1945] Elizabeth Bentley had volunteered information to the FBI field office in New Haven.” (p. 116) In fact, Bentley went to the Bureau office in New York on 7 November 1945. In another instance, Walton claims that Gouzenko mentioned Harry Gold, Klaus Fuchs’s courier, but he did not. And Gold was not, as the book claims, the one who identified Fuchs; it was the other way around.[2]
In sum, while Challenqes in Intelligence Analysis illustrates historical cases in which analysis was no doubt performed, the details of that analysis—how it was done; what one really needs to know—are omit-ted. The reader is left to resolve that.

FBI Spent One-Third Of Aviation Budget On Executive Travel, New Report Finds

A government investigation has found that one-third of the Federal Bureau of Investigation’s entire aviation budget between 2008 and 2012 was spent on executive transportation, including travel by attorneys general, FBI directors and other top bureau officials, according to a new report released Monday. The report found that in 2009, 33 percent of flights taken that year were for executive transportation. In 2012, 34 percent of aircraft use was for executive travel.
Ashed where executive transportation ranked on the “priority list” for airplane use, the bureau said such travel requests were “secondary.” “Investigative/operational missions are the FBI's highest priority, followed by required maintenance and pilot training missions,” the bureau said in the report. The bureau added that the “FBI pays for the cost of operating aircraft flown by the attorney general as part of its mission to protect him.” The bureau also said executive travel had never interfered with any operational flights.
Former Attorney General Eric Holder and former FBI Director Robert Mueller were among the Department of Justice officials who have used the FBI’s aircraft for business or personal travel. Between 2007 and 2011, Holder and Mueller, as well as then-Attorneys General Michael Mukasey and Alberto Gonzales, took nearly 700 trips not related to bureau intelligence operations, according to a previous government report. The trips' cost totaled roughly $11.4 million. In some cases, officials reimbursed the government for a portion of the expenses.
Holder has previously defended using the justice department’s plane for personal trips. “We didn’t have a reporting requirement that existed before,” Holder said during a House Appropriations Committee hearing in 2014 when asked whether he would report those trips to the General Services Administration in the future. “If they want to change those rules, we’d be more than glad to make sure that we share that information with the appropriate organization, but this is something that is really wide open.”
FBI officials’ use of the bureau’s private planes for business or personal travel came to light in 2013, but exactly what percentage of the bureau’s aviation budget went toward executive transportation was unclear.

Obama Legacy on Nuclear Arms Under Threat

WASHINGTON—As international talks over Iran’s nuclear program enter their critical final stage this month, a key goal of President Barack Obama’s presidency—curtailing the world-wide nuclear threat—hangs in the balance.
Mr. Obama’s campaign to stem the spread of nuclear weapons was cited as a main reason for his 2009 Nobel Peace Prize, but that signature effort has been bogged down amid a resurgence of Middle East turmoil, tensions between the U.S. and Russia and the growth of North Korea’s arsenal.
Senior U.S. officials cite the impending deal with Iran as a major step toward Mr. Obama’s nonproliferation objective. But many nonproliferation concerns have grown. Chinese scientists warned the U.S. in recent months that North Korea has expanded its arsenal to about 20 atomic bombs. And developing countries negotiating the future of the nuclear Nonproliferation Treaty at the United Nations last month, meanwhile, sharply criticized the U.S. and Russia for not doing enough to shrink their nuclear-weapons arsenals.
In recent years, aside from the Iran talks, “the administration has lost focus and momentum on the [nonproliferation] issue, especially as the Republicans have seized the majority in the Senate and tensions with Russia have worsened,” said Daryl Kimball, executive director of the Arms Control Association, a Washington think tank.
Even a deal to curtail Iran’s nuclear program in exchange for easing economic sanctions, a main goal, may lead only to a mixed record on disarmament. Key U.S. allies, particularly Israel and Saudi Arabia, are voicing fears the emerging deal won’t go far enough in blocking an Iranian path to a bomb. A number of Arab states have warned they could seek to match whatever nuclear capabilities Iran is allowed to maintain as part of a final deal.

The talks, facing a June 30 deadline, are under way in Vienna. U.S. and European officials involved in the diplomacy said disputes still exist with Iran over the future inspections of its nuclear and military sites and the timing of sanctions relief. These officials said the concerns of the International Atomic Energy Agency, the U.N.’s watchdog, to clarify Iran’s alleged past efforts to develop nuclear weapons technologies are unlikely to be addressed by month-end, but will need to be handled in stages.
“In terms of the actual timelines, the IAEA isn’t going by the 30th of June to be able to resolve its outstanding questions,” a Western diplomat said. “What the deal will have to do is make sure there is a mechanism by which it can do that.”
The Obama administration’s nonproliferation campaign, laid out along the lines of the 1970 Non-Proliferation Treaty, has focused on trying to deny atomic weapons to previously nonnuclear countries, reducing the stockpiles already held by the five U.N.-recognized weapons states, and facilitating the use of civilian nuclear technologies for countries that commit to not go down the weapons path.
Administration officials view the diplomacy toward Iran as a linchpin of this overall strategy. The White House believes an agreement with Iran will deny Tehran the capability to break out and build a bomb for at least 10 years, removing pressure on Saudi Arabia and Iran’s other regional rivals to pursue nuclear technologies.
Still, U.S. allies and adversaries alike have voiced suspicion of the Obama administration’s broader nonproliferation campaign. And developing countries—who are signatories to the treaty—criticized the U.S. and other weapons states last month for not moving fast enough to dismantle their nuclear-weapons arsenals.

Secretary of State John Kerry told an NPT Review Conference earlier this spring that the U.S.’s stockpile has fallen to around 4,700 nuclear warheads, 85% below its Cold War peak.
But Iranian Foreign Minister Javad Zarif, who heads the bloc of developing nations called the Non-Aligned Movement, told the same assembly this wasn’t enough.
“The nuclear-weapons states have not made progress in eliminating their nuclear weapons,” Mr. Zarif said. “The role of nuclear weapons in security policies of the nuclear-weapons states has not diminished.”
U.S. officials said growing tensions with Moscow over its move to annex the Crimean region of Ukraine last year is the primary factor undermining efforts to further reduce the countries’ arsenals.
The U.S. and Russia in 2010 reached an arms-control agreement, called the New Start Treaty, to cut in half the countries’ nuclear-missile launchers. But subsequent U.S. offers to the Kremlin to make additional weapons cuts haven’t been reciprocated, according to the Obama administration.

Meanwhile, nuclear threats have crept back into the international dialogue. Russia’s military publicly has said in recent months it should rewrite its official doctrine to allow for a pre-emptive nuclear attack on the U.S. European officials were stunned in March when Russia’s ambassador to Denmark threatened the country with nuclear-weapons reprisals if it joined a North Atlantic Treaty Organization missile-defense system.
“This makes for a very difficult environment to rapidly negotiate a reduction in nuclear weapons,” said the senior U.S. official. “We’re trying to make sure our concerns about their policies don’t take on a dynamic of their own.”
Israel’s undeclared nuclear-weapons arsenal is also challenging the Obama administration’s broader nonproliferation agenda.
Mideast countries, led by Egypt, pressed the U.N. last month to quickly convene an international conference aimed at establishing a nuclear weapons-free zone in their region. Some nations had been seeking to mandate the meeting be held as soon as this December.
Israel’s government—which neither confirms nor denies that the country possesses nuclear weapons—vehemently opposed the requirement that it attend the proposed conference in the absence of broader steps to address what it sees as threats to the Jewish state’s security.
Israeli officials voiced concern that the Arab states and Iran would seek to use the conference to force their country to disarm.
The Obama administration ultimately blocked the U.N. from holding such a conference due to Israel’s concerns. But Egyptian officials warned the White House the American veto would have long-term implications.
Mr. Obama, meanwhile, has acknowledged in recent weeks that Iran will likely to define his international record.
“Look, 20 years from now, I’m still going to be around, God willing. If Iran has a nuclear weapon, it’s my name on this,” Mr. Obama said in an interview last month with Atlantic Media. “I think it’s fair to say that, in addition to our profound national-security interests, I have a personal interest in locking this down.”

Confronted with questions about low-flying planes registered to mysterious companies, the FBI has admitted it maintains a fleet of aircraft, registered with bogus names, that it uses for surveillance without warrants. It defends the practice as necessary in its efforts to keep Americans safe. But Americans’ civil liberties need safeguarding, too, and the secret air force sounds like more unjustifiable overreach by a federal agency.
The Associated Press reported last week that it has linked 50 airplanes to the FBI, despite registration under dummy names such as FVX Research, NBR Aviation and PXW Services. Since late April, the news organization documented more than 100 flights in 11 states, covering cities and rural communities. The secretive nature of the program prevents the public from knowing what information the FBI is gathering and what is done with the pictures and data it collects.
Sen. Chuck Grassley, R-Iowa, has asked FBI director James Comey Jr. to explain the purpose of the air fleet, as well as the technological capabilities of the planes, to the House Judiciary Committee by June 12. While acknowledging the bureau is known to use planes in criminal investigations, Grassley told reporters he has concerns about warrantless intrusion into private and public space, as well as the invention of companies to hide ownership of the planes.
Given Americans’ increasing concern about Big Brother tactics in the endless war on terror, the AP report gives fresh cause for worry.
Sophisticated technology that can help keep Americans safe can also erode fundamental liberties. In short, even watchdogs need watching. The FBI may have very good reasons for what looks like unnecessary deceit. Let’s hear them.
