John Harwood writes in the Times today:
[T]he mechanism for congressional consideration, agreed on by Republican leaders and the White House, reverses the typical legislative imperative.  Instead of requiring an extraordinary majority to act, it requires one to stop action — which means partisanship is all President Obama needs to approve the deal.
The Republican-controlled House and Senate can pass a resolution next month disapproving the deal, as lawmakers in both parties expect they will.  Mr. Obama can then veto that resolution, as he has promised to do.  To override that veto and block the deal, Republican leaders would need two-thirds majorities in each chamber.  That would require roughly 25 percent of congressional Democrats to abandon the president on his biggest foreign policy initiative.  In 21st-century American politics, that is an exceptionally high bar.
This formula represents an unspoken attempt by both parties to dodge the consequences of gridlock on high-stakes governance issues. . . . Prodded by the senate Republican leader, Mitch McConnell of Kentucky, Congress let Mr. Obama raise the debate limit unless lawmakers blocked it, which required a veto override that proved unattainable.
In other words, according to the Times, the Corker/Cardin legislation (“the mechanism for congressional consideration, agreed on by Republican leaders and the White House”) “reverses the typical legislative imperative,” i.e., it requires supermajorities of both Houses to disapprove the deal rather then requiring a two-thirds vote of the Senate to approve the JCPOA, and Congress thereby “let Mr. Obama raise the debate limit unless lawmakers blocked it.”
This is mistaken in almost every respect, for reasons I explain in much greater detail in these twoposts, and (before Corker/Cardin was enacted) in my post with Jack Goldsmith here.
Because the deal with Iran itself is not binding as a matter of international law, the President had the constitutional authority to conclude it on behalf of the United States without any Senate or congressional approval, something that Corker/Cardin, and the upcoming vote, will not change.  (Even if Congress were to override the veto, the U.S. will still be a “party” to the JCPOA.)  What the debate, and the vote, is about is whether the President should be prohibited from waiving certain U.S. sanctions against Iran, as the U.S. has (politically) committed to do in the JCPOA.  Before Corker/Cardin was enacted, the President already had the power to waive those sanctions, wholly apart from the JCPOA, because Congress had delegated him that authority.  All that Corker/Cardin did, in effect, was to delay the President’s existing power to alleviate sanctions by 60 days (and to guarantee more extensive congressional oversight).
The upcoming votes, therefore, are merely about whether Congress will retractexisting statutory authority from the President.  In order to do such a thing, Congress always needs to enact a new law; and because a President will almost always veto such a bill stripping him of such an important authority, Congress would invariably need supermajorities of both Houses to alter the status quo.  This is the “typical legislative imperative”; overriding a veto is, to be sure, a “high bar,” but there’s nothing “exceptional” about it, and Corker/Cardin has not reversed it in the slightest, other than to give Congress two months of debate that it otherwise would not have had before the President can waive sanctions.

I Am Republican, Hear Me Roar

To hear most of the Republican candidates tell it, all an American president has to do is talk tough, make demands, send more troops overseas, pour billions more dollars into the Pentagon and the world will fall in line. The notion they’re peddling boils down to this: President Obama is weak, I am strong and America will be great again when I am in the White House.
Take Donald Trump, who on Sunday told NBC’s “Meet the Press” that the way to defeat the Islamic State (also called ISIS and ISIL) was to send American combat troops back into Iraq and take control of large sections of the country and its oil resources. Or Jeb Bush, who last Tuesday urged more robust military engagement in Iraq and Syria. He said he would involve Americans more deeply in the anti-ISIS fight alongside Iraqi troops, possibly increase the number of Americans there and establish a no-fly zone over Syria.
Mr. Bush and most of the other aspirants, including Senator Marco Rubio of Florida, Carly Fiorina, Gov. Scott Walker of Wisconsin (but not Mr. Trump), would also repudiate the deal under which Iran has committed not to produce nuclear weapons in exchange for a lifting of sanctions.
Republicans have long employed the Democrats-are-weak trope. But it’s harder to make that case after 16 years of Democratic presidents who did not hesitate to intervene forcefully when they thought it necessary — Bill Clinton in Bosnia and in Yugoslavia in defense of Kosovo and Mr. Obama in Iraq, Afghanistan and Syria and with prolonged drone strikes along the Pakistan border.
But as many people now realize, leadership in today’s multipolar world depends not just on a large army and the threat of force but also on the president’s ability to present America’s democracy as a plausible alternative to repression and radicalism and to wield all the tools at his disposal, including diplomacy, to achieve the nation’s goals. President George W. Bush’s swaggering approach to leadership and his headstrong use of force, especially in his first term, led to the disaster that still imperils Iraq today.
So far, the Republican candidates have offered mostly vague, disjointed ideas, mostly on the Mideast and disconnected from a coherent strategy and even sometimes from reality. Mr. Bush, for instance, has moved from saying his brother’s war in Iraq was a bad idea to asserting that the war had value because it overthrew Saddam Hussein. This reinterpretation of history is not reassuring, nor is his blaming Mr. Obama for abandoning Iraq when it was his brother who negotiated the deal under which all American forces would withdraw by the end of 2011.
Mr. Bush’s speech did not begin to address the hard questions of how he could do a better job than Mr. Obama of persuading Iraqis to defend their country or encourage a political climate in which all of Iraq’s sectarian groups might work together. Nor does Mr. Trump inspire confidence as a possible international leader when he seems to go out of his way to insult America’s allies.
Voters deserve a serious debate on foreign policy and the role Hillary Rodham Clinton, the Democratic front-runner, had in shaping it as Mr. Obama’s secretary of state. But for that to happen the Republican candidates have to offer a more honest analysis and more thoughtful solutions to the challenges facing the nation, including relations with China, not just red meat to their conservative base.

Russians Feel Ruble’s Fall, but Putin Remains Mostly Unscathed

RAMENSKOYE, Russia — A basic barometer of economic activity in this tidy town south of Moscow is the pirozhok, a small pie filled with cabbage and meat that is a staple of the Russian diet.
In good times they sell briskly, snapped up by hungry commuters at Arina’s Hangout, a tiny shop near the train station. But sales are down by almost half, a gloomy reflection of Russia’s economic slump.
“There were just physically fewer people,” said Irina A. Safonova, the owner of the shop, which on a recent weekday was serving pies to a slow trickle of customers. “We used to have lines. Now look at it.”
Russians are experiencing the first sustained decline in living standards in the 15 years since President Vladimir V. Putin came to power. The ruble has fallen by half against the dollar, driven by the plunging price of oil, the lifeblood of Russia’s economy. As a result, prices of imported goods have shot up, making tea, instant coffee, children’s clothes and back-to-school backpacks suddenly, jarringly expensive.
Making matters worse are the retaliatory bans that Russia placed on food imports after the United States and the European Union imposed sanctions for its actions in Ukraine, a policy that took a turn for the weird this month when the government destroyed thousands of tons of what it said were illegally imported foodstuffs including cheese and peaches.
The reduced supply means that what remains costs more, even if it is locally produced. Russians are paying a third more for sunflower oil, a fifth more for yogurt and three-quarters more for carrots compared with a year ago, according to government statistics. (The Western sanctions, for their part, have driven up the cost of borrowing for Russian companies, but they have not had a direct role in the inflation that is raiding Russian pocketbooks.)
Inflation has reduced the purchasing power of Russian wages by more than 8 percent in the second quarter, compared with the same period last year, according to figures published by Russia’s Central Bank at the end of July. And in a sign that the worst is far from over, the economy contracted by a steep 4.6 percent in the second quarter, compared with last year, and officially entered its first recession since 2009.
“It’s horrible,” said Elena Shcherbakova, a 47-year-old shoe saleswoman whose income, based in part on commissions, has fallen nearly a third since last year. She says she now shops at discount supermarkets, buys the cheapest kind of sausage and carefully counts containers of yogurt instead of throwing them into her cart by the handful the way she used to.
It is not clear what, if anything, this means for Mr. Putin. The trouble pales in comparison with the turbulent 1990s, when people’s wages went down by nearly half. Russians have an immense capacity for stoicism, and ubiquitous home gardens make budgets more flexible. Mr. Putin’s popularity ratings have remained high since last year’s annexation of Crimea, which was wildly popular among Russians.
Still, the math is proving tricky. In a new draft budget released in July, the Ministry of Finance proposed halting the practice of raising pensions to keep up with inflation, a politically controversial move that would deliver a blow to Mr. Putin’s most loyal base. Investment, food for a hungry economy, has collapsed since the Western sanctions, which also blocked Russia’s ability to borrow on global markets.
“They have no way out,” said Sergei Guriev, a professor of economics at Sciences Po in Paris. “Unless oil prices go up, they are really looking at a dead end.” Without further spending cuts and if oil prices remain around current levels, the government will use up its reserve fund, created when the price of oil was high, in about a year, he added.
Mr. Putin’s opponents argue that the shrill nationalist talk washing over Russia is being projected by his government to distract attention from the fragile economic situation. They describe it as a battle in every Russian home between the television (the source of government propaganda) and the refrigerator (whose shrinking contents could eventually prompt discontent).
In Moscow, some in the educated upper classes agree.
“All that Ukrainian noise covers up our internal problems,” said Maria Novychkova, a manager in a textile company who was walking a foot scooter in a park last month. Her company has put employees on four-day workweeks. She cannot afford to vacation abroad because of the weak ruble. “He says we are an ideal country, but we are not,” she said, referring to Mr. Putin.
The crisis in Ramenskoye is like a car crash in slow motion, gradual but destructive. The town has tried to modernize in recent years, with an airport for private jets and a PepsiCo juice factory. It is also a bedroom community for Moscow. Commuters are Arina’s main customers.
Ms. Safonova, the owner of the pie shop, first noticed a drop in business last fall. There were fewer commuters, and those who remained spent less freely. Once-packed minibuses emptied out. The checkout clerks at the nearby Kopeika supermarket had their wages cut. Then in March, PepsiCo announced that the juice factory in town was closing, citing the bad economy.
Prices began jumping. Nescafé went to 389 rubles (about $5.96) from 220 ($3.35) and Ahmad Tea to 319 rubles from 191. Ms. Safonova knew about the sanctions, and that the falling ruble made imports more expensive, but sometimes the logic eluded her. A spike in the price of mushrooms this spring was particularly puzzling.
“I said, ‘Why, why?’ These are grown near Moscow, right here, not in Europe!”
By summer, the pie shop’s sales had dropped by nearly half, and Ms. Safonova had to lay off four of her eight employees. She now works 18-hour days to compensate. She gave up her big kitchen and now mixes dough five times a day instead of 10.
Across Russia, the crisis has prompted a collapse in consumption. International airline travel has fallen almost a fifth since last year, and car sales are down 36 percent in the first half of this year. The production of train cars fell by a third, said Natalia Zubarevich, a researcher at the Higher School of Economics, because fewer goods needed to be transported. In another measure of economic distress, household ruble debt in arrears is up 43 percent since last July, according to the Central Bank.
“The cost of the crisis is being borne by everyone, spread around like butter on bread,” said Vladimir Gimpelson, the director of the Center for Labor Market Studies at the Higher School of Economics.
As business shrivels across the country, Moscow remains an economic beacon.
Alexandra Vasilieva, the cashier at Arina’s Hangout, is from the province of Smolensk in western Russia, where work had dried up so completely that her husband, a window installer, was making just a small fraction of his previous salary. So they came to Ramenskoye and now he commutes more than two hours each way to Moscow for mediocre money. Her son, an auto service worker in Smolensk, lost almost a third of his salary because fewer cars were being brought in for repairs and servicing.
“In the provinces, the wages are too small to live on,” she said. Her monthly salary in Ramenskoye — 20,000 rubles — is sinking in value, worth just $305, down from $416 in May.
As for Crimea, if she thinks about it at all, it is through the lens of economics.
“I’m sick of Crimea,” Ms. Vasilieva said. “I’m sad for people,” she said, referring to Ukrainian refugees, “but why are they getting all this government assistance?”
Further pinching Russians’ pocketbooks are trims the government is making to benefits doled out when times were flush. Pensioners in the Moscow region can no longer ride free on the Moscow Metro, a change that affects more than a million people in one of the most densely populated regions in the country. Apartment owners across Russia must now pay a repairs fee every month, which has prompted protests in some regions.
Lyudmila Grigorievna, 68, a retired accountant, said it was no longer worth it for her husband, an artist who works as a designer on housing projects, to commute into the city to supplement his pension — $153 a month.
“If all you have is a pension, you can’t afford to buy shoes,” she said, sitting on a park bench next to her grandson, who was eating a tall white puff of cotton candy.
Still, the discontent seems to bypass Mr. Putin.
“Honestly, we are so proud he is our president,” said Vyacheslav Alexeevich, 75, a retired factory manager, who was steering a mostly empty grocery cart through a Kopeika supermarket here last week. “Thanks to him, we have all of this,” he said, gesturing toward a glass display case of beet and potato salads, fried eggplant and pieces of chicken.
Then he called his wife to tell her that they were out of the cheapest hot dogs.

President Obama’s Department of Injustice

WASHINGTON — LAST month, President Obama used his clemency power to reduce the sentences of 46 federal prisoners locked up on drug-related charges. But for the last six years, his administration has worked repeatedly behind the scenes to ensure that tens of thousands of poor people — disproportionately minorities — languish in federal prison on sentences declared by the courts, and even the president himself, to be illegal and unjustifiable.
The case of Ezell Gilbert is emblematic of this injustice. In March 1997, he was sentenced to 24 years and four months in federal prison for possession with the intent to distribute more than 50 grams of crack cocaine. Because of mandatory sentencing laws, Mr. Gilbert was automatically sentenced to a quarter-century in prison, though even the judge who sentenced him admitted that this was too harsh.
At his sentencing, Mr. Gilbert noted a legal error that improperly increased his sentence by approximately a decade based on a misclassification of one of his prior offenses. In 1999, without a lawyer, he filed a petition seeking his release. A court ruled against him.
Nearly 10 years later, the Supreme Court issued a ruling in another prisoner’s case, confirming that Mr. Gilbert had been right. A public defender helped him file a new petition for immediate release in light of this new decision.
Mr. Obama’s Justice Department, however, convinced a Florida federal judge that even if Mr. Gilbert’s sentence was illegal, he had to remain in prison because prisoners should not be able to petition more than once for release. The “finality” of criminal cases was too important, the department argued, to allow prisoners more than one petition, even if a previous one was wrongly denied.
A federal appellate court disagreed, and in June 2010, three judges set Mr. Gilbert free. The judges rejected the administration’s argument as a departure from basic fairness and explained that it simply could not be the law in America that a person had to serve a prison sentence that everyone admitted was illegal. Mr. Gilbert returned home and stayed out of trouble.
Here’s where it gets interesting. There are many people like Mr. Gilbert in America’s federal prisons — people whose sentences are now obviously illegal. Instead of rushing to ensure that all those thousands of men and women illegally imprisoned at taxpayer expense were set free, the Justice Department said that it did not want a rule that allowed other prisoners like Mr. Gilbert to retroactively challenge their now illegal sentences. If the “floodgates” were opened, too many others — mostly poor, mostly black — would have to be released. The Obama administration’s fear of the political ramifications of thousands of poor minority prisoners being released at once around the country, what Justice William J. Brennan Jr. once called “a fear of too much justice,” is the real justification.
In May 2011, the same court, led by a different group of judges, sided with the original judge, saying that the “finality” of sentences was too important a principle to allow prisoners to be released on a second rather than first petition, even if the prison sentence was illegal. A contrary rule would force the courts to hear the complaints of too many other prisoners. Mr. Gilbert was rearrested and sent back to prison to serve out his illegal sentence.
Judge James Hill, then an 87-year-old senior judge on the appellate court in Atlanta, wrote a passionate dissent. Judge Hill, a conservative who served in World War II and was appointed by Richard M. Nixon, called the decision “shocking” and declared that a “judicial system that values finality over justice is morally bankrupt.” Judge Hill wrote that the result was “urged by a department of the United States that calls itself, without a trace of irony, the Department of Justice.”
Judge Hill concluded: “The government hints that there are many others in Gilbert’s position — sitting in prison serving sentences that were illegally imposed. We used to call such systems ‘gulags.’ Now, apparently, we call them the United States.”
Two years later, the Justice Department used a similar tactic to overturn an entirely different federal appellate court decision that could have freed thousands of prisoners convicted of nonviolent crack cocaine offenses — again, mostly impoverished and mostly black — on the grounds that their sentences were discriminatory and unjustifiable. The administration again did its work without fanfare in esoteric legal briefs, even as the president publicly called the crack-cocaine sentencing system “unfair.”
In 2013, several years after sending him back to prison, Mr. Obama granted Mr. Gilbert clemency, and the president has recently won praise for doing the same for several dozen other prisoners of the war on drugs. Mr. Obama even visited a federal prison last month, staring into the cells — emptied for his visit — of some of the men whom his own administration has needlessly kept there.
But Mr. Obama must take steps to further undo the damage that he has done. He should use his clemency power to release all those currently held in a federal prison on an illegal sentence. And he should appoint a permanent special counsel whose job would be to review new laws and federal court cases on a continuing basis to identify and release other prisoners whose sentences retroactively become clearly unlawful. That the Department of Justice and Bureau of Prisons have never created such a position is an outrage. If we fail to demand change now, this moment for justice may be lost.

Latest CNN Republican Poll Has Donald Trump at 24% - First Draft. Political News, Now.

Support for Donald J. Trump remains robust among Republicans after the first debate, according to anew poll from CNN that shows nearly a quarter of the party’s likely voters would support his nomination for president.
According to the latest survey, Mr. Trump leads the Republican field by a large margin with 24 percent supporting his White House bid. Former Gov. Jeb Bush of Florida, whose standing dipped after the debate, is in second place with 13 percent, and Ben Carson, whose prospects have improved, comes in third at 8 percent.
The poll also shows improvement for Carly Fiorina, who appears increasingly likely to make the main stage — the top 10 tier — for next month’s debate that is hosted by CNN. However, Senator Ted Cruz of Texas, Gov. Chris Christie of New Jersey and former Gov. Mike Huckabee of Arkansas remain locked in a three-way tie at 4 percent, meaning that one of them could be relegated to the second-tier debate in September.
CNN’s survey, which had a margin of error of 5 percentage points, is in line with a Fox poll from this week that showed Mr. Trump maintaining his lead despite what some analysts called a mixed debate performance. The billionaire businessman was criticized afterward for being confrontational with one of the debate moderators, Megyn Kelly, and for his handling of questions about his previous remarks about women, but the debate does not appear to have damaged him.
Republicans gave Mr. Trump top marks for how they think he would handle the economy, immigration, the Islamic State and social issues if he were elected president.
Despite that sentiment, however, 58 percent of Republicans think the party would have a better chance of winning the presidency if someone else was the party’s nominee.

SEVASTOPOL, Crimea Russian President Vladimir Putin on Tuesday blamed the Ukrainian government for the latest upsurge in fighting between Kiev forces and Russia-backed rebels in eastUkraine.
After taking a dive in an underwater submersible in Crimea, a Black Sea peninsula Moscow annexed from Kiev last year, Putin told reporters:
"Regrettably, we are now seeing this conflict escalation and the blame lies not with the Donbas militia but with the rival side," he said, referring to the rebel-held Ukrainian region.
"I hope there won't be full-scale direct clashes."
